Description: The subject of the contract is the provision of services consisting in the collection and management of municipal waste from the owners of residential properties located in the Oborniki Śląskie commune.
The area of the commune is 153.75 km.

The number of inhabitants of the commune is as follows: 17 806 (according to the declarations submitted).
The commune consists of the town of Oborniki Śląskie, 23 villages and 3 hamlets:

The number of export points broken down by individual localities according to the data resulting from the declarations submitted as at 14.9.2018 is 5 530. The Contracting Authority reserves the right to increase or decrease the number of properties serviced in the field of municipal waste collection, which results from the submission of new declarations or their corrections.
Single-family housing predominates in the commune.
In exchange for the fee for municipal waste management paid by the real estate owner, the following waste is to be collected from export points:
- unsorted (mixed) municipal waste,
- paper and cardboard,
- glass,
- plastics,
- multi-material packaging,
- biodegradable waste - green waste (grass and leaves, small branches),
- metal,
- out-of-date medicines.
a. Plastic packaging (code: 150102) - 395,60 [Mg].
b. Glass packaging (code: 150107) - 417,79 [Mg].
c. Paper and cardboard packaging (code: 150101) - 274,78 [Mg].
d. Unsorted municipal waste (code: 200301) - 3877,38[Mg].
e. Biodegradable waste (code: 200201) - 2059,52 [Mg].
f. Out-of-date medicines (code: 200132) - 0,259 [Mg].
TOTAL: 3147,949 Mg of segregated municipal waste
TOTAL: 3877,380 Mg of mixed municipal waste
The above amounts of waste are based on the reports of entities providing waste collection services from the Oborniki Śląskie commune in 2017.
The quantities of waste listed above should be treated as indicative.
The Contracting Authority shall provide the Contractor with a list of properties inhabited by municipal waste with addresses, declaration of segregation or lack thereof, not later than 14 days before the commencement of the service. The contractor must consult the list of export points in order to avoid failure to carry out the waste disposal service.
The contracting authority informs that the lists in question will be subject to change.
In connection with corrections or new fare declarations by residents.
Implementation of the subject of the contract in 2019 will take place on the basis of the schedule provided by the Contracting Authority.
a) The Contracting Authority and the Economic Operator are obliged to place the waste disposal schedule on their own website and display it throughout the entire period for which it has been prepared.
(b) The contractor shall be obliged to provide the owners of real estate with a waste disposal schedule in the event of a change in the timetable. The schedule shall be communicated to the Contractor on the day of signing the contract.
The contracting authority shall provide for the collection and transport of waste as part of the invitation to tender, hereinafter referred to as 'individual invitation to tender'.
a) the Awarding Entity shall provide the Economic Operator with the following information
About the necessity of executing a unit order in writing, by telephone, e-mail or fax - depending on the needs.
b) Interventional collection and transport may take place, inter alia, when organising stock collections, overfilling containers and from publicly available nests for municipal waste segregation indicated by the Contracting Authority at the time of overfilling;
c) The deadline for the execution of a unit order is to be within 2 working days from the date of receipt of the order by the Economic Operator.
The subject of the contract was divided by the Contracting Authority into 2 parts:
Part I:
Includes collection and management of: non-segregated (mixed) waste and biodegradable waste.
The frequency of waste collection is the same for all localities in the Oborniki Śląskie commune, i.e.: Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie and Oborniki Śląskie:
Collection of unsorted (mixed) waste and biodegradable waste.
- at least once a week for mixed waste from multi-apartment buildings,
- at least once every two weeks for mixed waste
Made of single-family houses;
- at least once every two weeks for single-family houses and at least once a week for multi-family buildings in the vegetation period of plants, i.e. from 1 April to 30 November each year for biodegradable waste (green waste). Beyond the indicated growing season, biodegradable waste will be collected at least once a month.
COLLECTION OF WASTE
Part I. Collection of unsorted (mixed) waste and biodegradable waste.
1. the Contractor is obliged to collect mixed waste,
From before each inhabited property, accumulated
In containers or containers with the frequency indicated in the Regulations for maintaining cleanliness and order in Oborniki Śląskie Commune. In the case of properties which are difficult to reach, the Contractor shall be obliged to ensure planned collection with a smaller vehicle. At the moment it is 15 points. The Ordering Party reserves the right to change their number. These points will be transferred to the Contractor on the day of signing the contract.
The Contractor is obliged to collect mixed waste.
From containers with technical requirements with a specified capacity of
In the Regulations for maintaining cleanliness and order in the Oborniki Śląskie Commune. The Contractor is obliged to clean up any waste spilled during the performance of the service.
3. in the commune there are also containers with a smaller capacity or without metal wheels purchased by the inhabitants
In previous years. They are suitable for collection by garbage trucks (they can be used until they are destroyed).
The Contractor is obliged to collect waste from the transshipment point located on plot no. 1/26 M-1 in Golędzinowo, coming from the emptying of municipal and rural containers (approx. 170 pieces with a capacity of 30 l-70l) collected by the Municipal Company.
5. biodegradable waste (green waste) collected
In brown bags for separate collection with a minimum capacity of 120 litres, marked 'BIO' and meeting the conditions laid down in Part II, i.e. the remaining fractions of separated waste.
Conditions common to Parts I and II
In the case of a justified complaint about the lack of waste collection from the property owners, the Contractor is obliged to collect the waste within 2 working days from the date of notification by the Ordering Party.
The Contractor should have a storage and transport base located within the area to which it holds a legal title, no more than 60 km from the border of the Oborniki Śląskie commune (Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners, Journal of Laws of 2013, item 122).
The Contractor is obliged to weigh each empty container / garbage truck /collective vehicle before the start of collection and full mixed and segregated precipitation on a scale after the end of collection.
In the PSZOK in Golędzinowo or any other weight - only
In justified cases, e.g. random events, scale failure, meeting the requirements specified in the Act of 11.5.2001 on measures (i.e. Journal of Laws of 2018, item 376, as amended). Documentation from measurements should be provided in monthly reports with attached copies of the RIPOK waste transfer cards. The amount of collected and weighed waste from the commune should be comparable to the values (weighs) resulting from the attached copies of the waste transfer cards to RIPOK.
The Contractor is responsible for the destruction or damage to the containers for collecting waste belonging to the owners of real estate, arising in connection with the implementation of the subject of the contract.
The municipal waste collection system does not include waste generated as a result of business activity.
The Ordering Party does not require indication in the offer of waste processing installations to which the Contractor will transfer particular types of waste. This is to take place in accordance with Article 6d(4)(5) of the Act of 13 September 1996 on Maintaining Cleanliness and Order in Communes - the Contractor is to indicate the installation in the tender.
III. SANITARY STANDARD OF SERVICE PROVISION
The Contractor is obliged to collect municipal waste:
- in a continuous manner that does not interfere with night-time silence,
- within the time limits set out in the agreed collection schedule,
- regardless of weather conditions,
- vehicles designed to collect individual fractions of waste in such a way as to preclude mixing of waste or contamination of individual fractions.
The Contractor shall be obliged to maintain the vehicles and equipment used for the execution of the subject of the contract in proper sanitary and technical condition. Vehicles and equipment should be:
- efficient,
- have up-to-date technical tests,
- protected against uncontrolled leakage of waste during storage, handling and transport,
- put into service and marked with the trader's visible name and telephone number.
In the event of a vehicle breakdown, the Contractor shall be obliged to provide a substitute vehicle with similar parameters, enabling the service to be provided in a proper manner.
The Contractor shall be obliged to immediately clean up the waste and the consequences of its spillage (dirt, stains, etc.). The obligations described above apply only if waste spillage occurred during the performance of the service of collecting and transporting the collected waste.
The Contractor is obliged to wash and disinfect the vehicles and equipment used for the execution of the subject of the contract with the frequency guaranteeing the proper sanitary condition of the vehicles and equipment.
The Contractor shall be obliged to execute the order in accordance with the applicable provisions of law.
IV INFORMATION REQUIRED OF THE ECONOMIC OPERATOR DURING PERFORMANCE OF THE SUBJECT-MATTER OF THE CONTRACT
1) The Economic Operator shall be obliged to immediately provide the Contracting Authority with information on waste collection in the Oborniki Śląskie commune, in particular its mixing or preparation for collection in inappropriate containers, which does not comply with the Regulations on maintenance of cleanliness and order in the Oborniki Śląskie commune. The information shall include
In particular:
a) address of the real estate on which waste is collected in a manner inconsistent with the Regulations on maintenance of cleanliness and order in the Oborniki Śląskie commune,
(b) digital photographs proving that waste is collected incorrectly. Photographs must be taken in such a way that there is no doubt as to whether the containers/bags can be assigned to a specific property,
2) The Economic Operator shall be obliged to provide current addresses of residential properties on which waste is generated and are not included in the database maintained by the Awarding Entity.
3) Information referred to in points (a), (b), (c), (d), (e) and (f). 1 and 2 The Contractor shall send an e-mail to oborniki@oborniki-slaskie.pl or odpady@oborniki-slaskie.pl
4) The Economic Operator shall be obliged to report to the Awarding Entity any irregularities occurring or noticed during the performance of the service.

The frequency of waste collection is the same for all localities in the Oborniki Śląskie commune, i.e.: Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie, Oborniki Śląskie and Oborniki Śląskie:
Collection of segregated waste:
- at least twice a month for plastic, metal and multi-material packaging waste,
- at least once a month for waste paper and cardboard and glass.
The contracting authority envisages the possibility of changing the frequency of waste collection, e.g. in the case of housing communities.
COLLECTION OF WASTE
Part II. Collection of segregated waste:
The Contractor is obliged to collect municipal waste collected selectively, i.e. in sacks/containers/commercial sockets used for selective collection and to deliver sacks for segregation.
Bags for the collection of segregated waste must meet the following conditions:
1) be made of LDPE plastic with a thickness ensuring the durability of the bags, i.e. at least 60 microns, (a bag with a ribbon attached to the bag or with a strap or with ears allowing the bag to be tied) issued for exchange in the quantity corresponding to the quantity received. In the case of fractions - metals, plastics and paper - it is possible to use bags with a thickness of 40 microns.
2) include a permanent indication of the Contractor's name or logo and the name: Oborniki Śląskie Commune,
3) be marked in a manner enabling identification of individual fractions of waste in accordance with the applicable provisions of law:
(a) paper and board packaging collected in blue bags
With a minimum capacity of 120 l with the inscription 'PAPIER',
(b) plastic, metal and multi-material packaging collected in yellow bags of a minimum capacity of 120 litres with the words 'METALS AND ARTICLES',
(c) glass packaging, collected in green selective collection bags with a minimum capacity of 120 l and the inscription SZKŁO.
The Contractor is obliged to provide property owners with bags for selective collection of waste as part of the service. In case of a higher demand for bags, the contractor should hand over the number of bags indicated by the owner of the property.
The Contractor is obliged to collect waste selectively collected in public nests, in the number of 102 pieces placed in the parishes and the town of Oborniki Śląskie and to clean up the waste located near the containers - within a radius of up to 4m. The number of nests may be slightly modified if containers need to be added / removed, depending on the needs identified in the field. The list and location of nests will be provided on the day of signing the agreement.
5. the Contractor shall be obliged to collect overdue medicines
Out of four specialist containers located in pharmacies: at 42 Dworcowa Street, Maria Skłodowska-Curie 1, Podzamcze 2A in Oborniki Śląskie and in the Health Centre building at 70 Główna Street.
In Pęgów - collection not less frequently than once a month - on dates agreed with the Ordering Party.
Conditions common to Parts I and II
