RV Legal support for BSI in the management of BSI properties

Short description:
The aim of this procurement procedure is to award a framework contract for consultancy services to provide legal support for BSI's property management. In this context, property management is understood to mean the contractual drafting of the lease agreements, including contract negotiations and representation of the interests of the BSI in relation to the BImA and third parties. In addition, there are all other contractual relationships directly related to the BSI's properties (such as maintenance contracts, cleaning and care contracts, obtaining necessary permits, security services, etc.).
The main focus of the framework agreement is to be legal advice on the legal structure of specific contractual relationships as well as general advice and examination of commercial tenancy law, contract law and possibly also public procurement law issues in connection with property management. In this context, not only the permissibility and feasibility of projects should be demonstrated, but also the associated potential and risks in the case of high-volume tenant investments.

6 The client
Furthermore, the contractor may have to participate in negotiation procedures in the context of leasing and other contractual relationships associated with the properties for BSI. If requested by the client, the implementation of evaluative presentations in ongoing projects should be legally accompanied. Such procedures must be documented by the contractor in a factually comprehensible manner by means of written statements. The statements must include the recommended measures and proposed decisions as well as the reasoning or derivation on which the respective decision is based. The applicable legal provisions and regulations for the design of contracts in the public law legal framework must always be observed.
The tendered service is a classified information contract within the meaning of Section 104 (1) No. 4 GWB, as a not insignificant proportion of the BSI's contracts are classified information contracts and the contractor itself is highly likely to come into contact with such classified information. For this reason, the contractor must at least be able to handle classified information with the classification level VS-Nur für den Dienstgebrauch. Furthermore, collisions with other previous, current and future consultancy assignments in connection with the scope of services described must be ruled out.
