Description
By virtue of the provision of Article 26a of the Waste Act of 14 December 2020, the President of the City of Mysłowice is obliged, as a public administration body, to take action to remove and manage waste in the event that, due to a threat to human life or health or the environment, it is necessary to remove such waste immediately. Such a situation occurs with respect to waste currently held on the land plot located in Mysłowice at 50 Brzezińska Street (area of approx. 0.55 ha). This waste is in a liquid state and is stored in "mauzer" tupu containers and metal barrels. This is hazardous waste. The estimated amount of waste is about 8,000 Mg. The containers are placed directly on the ground, also in uncured places. There is no free passage between the containers. The regulations in force require removal and neutralization of the indicated waste.
The Mayor of the City of Mysłowice is in virtue of Article 26a. of the Waste Act of 14 December 2020 (Journal of Laws of 2020, item 797, as amended) is obliged as a public administration authority to take action to remove and manage waste in the event that, due to a threat to human life or health or to the environment, it is necessary to remove such waste immediately. This is the case with respect to waste currently held on the plot of land with geodetic number 2171/78 located in Mysłowice at 50 Brzezińska Street (area of approximately 0.55 ha). This waste is in a liquid state and is stored in "mauzer" tupu containers and metal barrels. The estimated amount of waste is about 8,000 Mg. The containers and barrels are unstable, stacked one on top of another, at a height of several meters. The containers are placed directly on the ground, also in uncured places. There is no free passage between the containers. The markings on the containers indicate that the waste contains substances toxic to the target organs and the environment, has irritating or corrosive properties due to the pH value, contains flammable substances. It should be assumed that the waste has dangerous properties. The nearest residential buildings are located about 150-200 metres from the waste storage area; on the immediately adjacent plot there is a hall with several hundred employees in three shifts. Some of the containers have already been unsealed and substances have leaked. Some of the bins are overturned. The bins are arranged chaotically, two or three of them one on top of the other. The ordering party did not conduct any research on the waste in question as to its chemical composition. According to the suggestion included in the decision of the Voivodeship Inspector of Environmental Protection in Katowice, due to the lack of possibility to precisely determine the type of waste in particular containers, they were classified under code 19 12 11* - other waste (including mixed substances and objects) from mechanical waste treatment containing dangerous substances. As part of subsequent correspondence, the Voivodeship Inspector of Environmental Protection in Katowice explained that the previously indicated code 19 12 11* is not the only one that can be assigned to this type of substances - in his opinion, other codes corresponding to this type of waste can also be used interchangeably, including codes from group 16 - waste not included in other sub-groups. In view of the circumstances presented above, the basic needs of the ordering party are: 1) removal of waste from the place where it is currently stored, 2) securing the area after waste disposal, 3) carrying out the process of its disposal. The Contracting Authority, not knowing the chemical composition of the waste, is not able to determine the method of transporting the waste to the place of its neutralisation and to describe the neutralisation process itself. Determination of this method of transport and the process of neutralization will take place within the framework of competitive dialogue after the contractors have carried out the necessary tests and analyses on the basis of documentation prepared by the contractors.
