Description
The Werdohl town council has decided to build a new fire station for the Stadtmitte fire department of the Werdohl volunteer fire department. Planning up to and including work phase 4 has already been completed. The building application has been submitted to the Werdohl building authorities and will be approved shortly. The service phases 5 to 9, as well as the turnkey construction of the building, are now to be put out to tender and awarded to a general contractor.the client intends to build a new fire station in Grasacker Street. The GFA is approx. 1,810 m² and the BRI approx. 8381 m³. For a further description of this measure, please refer to the building application documents, in particular to Annex 01 - Building description and Annex 04 - Technical construction template with the planning documents for the building. The construction work is awarded by means of a service description with a service program (so-called functional service description, hereinafter "FLB"). The service description is based on the building application documents and the planning documents prepared by the specialist planners. As a general contractor, the contractor is responsible not only for the turnkey construction of the fire station but also for the coordination of all planning and construction services in accordance with the functional specifications with the aim of eliminating interface problems between the individual planning disciplines and the individual trades. One of the contractor's key contractual obligations is to inform the client regularly and completely about all key project content and to allow the client to carry out inspections. Furthermore, the contractor must submit maintenance contracts for the technical systems and the green roof for 5 years after acceptance, including the costs incurred. The contracts shall be concluded by the Client. The Contractor has gained knowledge of the Client's objectives and the framework conditions for their implementation, as set out in this contract and the annexes. The Contractor undertakes to contribute its entire know-how in order to achieve the owed quality in planning and construction. Accordingly, the contracting parties are dependent on close cooperation and partnership in the interest of a goal-oriented and trouble-free construction process.against this background, they mutually undertake to reach an amicable understanding of the contract in the event of conflict and to give priority to a short-term, goal-oriented solution to any factual and legal issues over the exercise of design rights, defenses or rights of retention.planning services:The contractor receives the building permit documents including planning documents together with the functional service description. The Contractor shall have no claim against the Client for the handover of further planning documents, unless expressly stated otherwise in the contract and its annexes. Accordingly, the Contractor shall prepare all further planning documents required for the implementation of the functionally described service on its own responsibility and at its own expense in good time so that the deadlines specified in Section 7.1 of the general contractor agreement are met. In particular, the Contractor shall prepare the aforementioned implementation planning in accordance with the General Terms and Conditions of Contract and hand it over to the Client.The Contractor undertakes to carry out the maintenance of the building structure (KG 300) and the technical building equipment (KG 400) in accordance with the General Terms and Conditions of Contract.Construction services:The Contractor shall construct the defect-free, turnkey building with outdoor facilities that is fully functional for the planned operation in accordance with the contractual bases specified in § 2 of the General Contractor Contract. He shall be responsible for all work and materials required for the complete execution of the services described in the aforementioned contractual bases. In particular, this also includes all necessary preparatory, ancillary and finishing work, irrespective of whether these are ancillary services or special services in accordance with VOB/C. The services owed also include all specifications from the building permit, including any conditions and requirements, and it is clarified that the contractor owes all services required for the work results described in the FLB. Due to the functional nature of the service description, the contractor is therefore free to decide how to achieve the performance successes owed on the basis of the service description and the contract components specified in § 2. However, as minimum requirements, the Contractor must comply with the specifications of the FLB together with the annexes in accordance with the list of documents, the building permit and the details specified therein; due to the functionality of the service description, services not described in detail but required for the purposes of a complete turnkey service are part of the complete service owed and covered by the agreed remuneration, unless the Contractor could not have expected this, even taking into account its preliminary project involvement, usual preliminary inspections, analysis of the contract components and the other requirements of a corresponding project. Accordingly, the Contractor shall only assume the subsoil and contaminated site risk to the extent that it is recognizable from the contract components in accordance with § 2 of the general contractor agreement, and the Contractor shall commence performance of the services immediately after the contract is awarded (start date). Completion of all services owed on the basis of this contract shall take place by 30.09.2026 at the latest (overall completion date).
