Description

3.1 The subject matter of the contract is the execution of the following works: "Construction or reconstruction of agricultural transport routes, renovation of drainage ditches and land reclamation" for the project entitled, "Construction or reconstruction of agricultural transport routes, renovation of drainage ditches and land reclamation",Land consolidation of the villages of Chałupki and Gorliczyn "Szewnia" gmina Przeworsk on the area of 145.08 ha" under the measure "Support for investments related to the development, modernisation and adaptation of agriculture and forestry" included in the Rural Development Programme for 2014-2020".3.2. The scope of the works includes: - construction or reconstruction of rescue roads (agricultural transport) together with culverts under roads and slides to plots of land with a total length of 10.543 km,- renovation of drainage ditches with a total length of 5.09 km,- land reclamation - area 0.70 ha.3.3 The detailed scope of works is specified in the design documentation constituting Annex 9 to ToR.3.4 The Contracting Authority recommends an on-site inspection of the construction site subject to the contract. At the same time, the Awarding Entity informs that the recommended local vision is not a binding element of the ToR within the meaning of art. 9a sec. 2 of the Act PPL.1) Pursuant to art. 29 sec. 3a of the Act, the Awarding Entity demands that during the performance of the subject matter of the contract, the Contractor or subcontractor should employ a Contractor or a subcontractor on the basis of an employment contract, within the meaning of the Act of 26.6.1974. - Labour Code (Journal of Laws of 2019, item 1040, as amended), persons performing the following activities, to the extent consistent with the design documentation, related to:1. grubbing up trees, bushes or sheathing;2. removal of layers of fertile soil;3. dismantling elements of roads, fences and culverts;4. making excavations, embankments;5. making a trough with profiling;6. making layers of sub-base;7. making a layer of reinforcement layer;8. 9. reinforcement of embankments, ditches and sewage systems; 10. laying culverts; 11. setting up a fence; 12. levelling the ground; 13. ploughing and soil loosening and grinding; 14. cleaning ditches and culverts; 15. vertical adjustment of sewage wells. Except for persons responsible for site management, i.e. site and works managers and other persons performing independent technical or supervisory functions.2) During the contract execution, the Contracting Authority shall have the right to perform control activities towards the Contractor with respect to the Contractor's or subcontractor's compliance with the requirement to employ, on the basis of the employment contract, persons performing the activities indicated by the Contracting Authority in the scope of contract execution. In particular, the Awarding Entity shall be entitled to: a) request declarations and documents to confirm the fulfilment of the above requirements and evaluate them; b) request explanations in the case of doubts as regards confirmation of fulfilment of the above requirements; c) carry out on-site inspections of performance.3) In order to verify the employment by the Contractor or sub-contractor on the basis of the employment contract of persons performing the activities indicated by the Awarding Entity in the scope of contract performance, the Contractor shall submit to the Awarding Entity at its every request:a) a statement of the Contractor or sub-contractor on the employment of an employee on the basis of the employment contract containing information, including personal data, necessary to verify the employment on the basis of the employment contract, in particular the name and surname of the employed employee, date of conclusion of the employment contract, type of employment contract and scope of the employee's duties.
