Poland - Planting services and maintenance of green areas

Description

The subject matter of the contract shall include performance of the task entitled: "Development of greenery on the Philadelphia Boulevard - part III".2. The subject matter of the contract shall include greenery in the area of the Philadelphia Boulevard between the walls of the Old Town and the strengthening of the Vistula River waterfront, on the section from the J. Piłsudski road bridge to the E. Malinowski railway bridge. J. Piłsudskiego to the E. Malinowski railroad bridge, by carrying out new plantings of trees, shrubs, perennials, bulbous plants, ornamental grasses, as well as establishing lawns and finishing works, on a total area of 33,838 m².
(1) The subject of the contract includes the performance of greening works, including: 1) preparation of designated areas for planting in accordance with the principles of the art of gardening,2) removal and disposal of waste materials,3) performance of planting of trees, shrubs, perennials, bulbous plants, ornamental grasses and establishment of lawns by hydroseeding, in accordance with the principles of the art of gardening,4) performance of finishing works (agro-textile, mulching with composted wood chips, pebble paving, etc.),2.The Contractor shall execute the subject matter of the contract to the extent and in the manner specified in the detailed design by Ms. H. Pawlowska and Ms. K. Ostojska and annexes:1) Annex no. 1. Scope of the subject matter of the contract - part 3, 2) Annex no. 2. Detailed design - greenery,3) Annex no. 3. Annex to the detailed design - development of the boulevard part 3,constituting an integral part of the model contract. 3.. The Contractor shall replace specimens of plants that die or are in poor condition with defect-free plants within the warranty period indicated in § 2.3 of the model contract. 4.. As part of the contract, the Contractor shall also be obliged to export all waste generated in connection with the performance of the subject of the contract to the municipal landfill. Costs associated with this, including fees for storage of waste at the landfill shall be borne by the Contractor as part of the remuneration under the contract. 5. a detailed description of the subject matter of the contract and the requirements for the Contractor are contained in the model contract (Annex No. 6 to the SWZ) and annexes to the model contract.6. provisions on equivalent solutions are contained in point 6 of the SWZ.7. the term of the contract - 25 weeks from the date of signing the contract.8. the Employer requires the employment by the Contractor or subcontractor on the basis of a labor contract of persons performing physical activities and operation of machinery in greening works, the performance of which consists in the performance of work as specified in Article 22 § 1 of the Act of June 26, 1974. - Labor Code (Journal of Laws of 2022, item 1510). Details of the requirements for employment on the basis of an employment relationship are contained in the model contract, attached to the SWZ9. A bid bond in the amount of PLN 30,000.00 (in words: thirty thousand zlotys)should be paid before the bid submission deadline. The term of validity of the bid security should be consistent with the bid validity period.The bid security may be paid in the following forms:a) in cash - to the account of the Public Procurement Office No. 62 1160 2202 0000 0003 3943 1400 with the annotation: bid security - No. 122/2023- "Greenery management of the Philadelphia Boulevard - part III "The date of payment of the bid security shall be the date of its receipt in the account of the Contracting Authority.Execution by the contractor of an instruction to make a transfer order cannot be equated with payment by bank transfer to the bank account of the amount of the deposit. The issuance of a transfer order results in certain actions on the part of the bank to implement the given instruction under the terms of the bank account agreement. Thus, the instruction itself is not tantamount to making a payment.Thus, only the relevant amount in the ordering party's account for the bid security determines its payment, and effective payment of the bid security will occur when the amount of the bid security in the ordering party's account is credited before the deadline for submission of bids.b) bank guarantees or guarantees of a cooperative savings and loan association,c) bank guarantees,d) insurance guarantees,e) guarantees provided by entities referred to in Article 6b(5)(2) of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development (i.e., Journal of Laws of 2018, item 110).If the bid security is provided in the form of a surety or guarantee, the contractor shall provide the contracting authority with the original guarantee or surety in electronic form. 10.The provisions on the rules for the return of the bid security are set forth in paragraph 16 of the SWZ.
