The subject of this publication is the conclusion of non-exclusive discount agreements according to §130a para. 8 SGB V for medicinal products for the following active ingredients:1. active ingredient Ustekinumab,2. active ingredient Piribedil.All interested and suitable pharmaceutical companies are offered to conclude a discount agreement according to §130a para. 8 SGB V under the provision of uniform conditions and a uniform access procedure. Exclusivity is not given. The purchase quantity is unknown at the time of conclusion of the agreement and depends in particular on the demand of the insured persons, the development of the number of insured persons, the prescription behaviour of the contract physicians and the dispensing and stocking behaviour of public pharmacies. The client does not guarantee minimum purchase quantities; for further information, see point II.2.4) of the notice.
Interested pharmaceutical companies can request the participation documents (discount agreement, self-declaration of non-exclusion, declaration of conformity) via the e-mail address stated under I.1), stating the lot and active ingredient. Agreements within the scope of this model are concluded in the period from January 4, 2021 to February 28, 2022. Interested parties must submit the fully completed and signed participation documents (self-declaration of non-exclusion, discount agreement in duplicate, declaration of conformity) by post to the office named under I.1) for the first time by 31.12.2020, and thereafter by the 15th of each month. It depends on the receipt of both AOK PLUS. If the 15th of a month falls on a Saturday, Sunday or national public holiday, the next working day will replace such day. In case of later receipt (after 31.12.2020 or 15th of a month), the submitted participation documents will be considered for the 15th of the following month. The discount agreement comes into force as soon as the AOK PLUS has signed the discount agreement after receipt of the complete documents signed by the pharmaceutical entrepreneur. With the exception of the first-time submission, the signing of the discount agreement takes place until the end of the month in which the participation documents must be received by the AOK PLUS. From an organizational point of view, the AOK PLUS requires a lead time of about half a month to register the discount agreement. The initial labelling of the discount medicines in the pharmacy software takes place from the second month following the deadline for receipt of the participation documents. This date may vary if the deadlines for reporting key dates in the nationwide AOK contract reporting portal DatRabatt are changed or redefined. A rebate agreement is concluded with all pharmaceutical companies that meet the participation requirements and confirm this by signing the requested document confirmations. The AOK PLUS reserves the right to terminate the open-house procedure prematurely, particularly in the case of the conclusion of exclusive discount agreements. In this case, the contracts already concluded will end in accordance with the contractual provisions. According to the experience of the AOK PLUS, exclusive discount agreements generally come into force 8 to 12 months after publication of the corresponding tender notice in the Supplement to the Official Journal of the European Union. Future contract partners in the open-house model are requested to inform themselves regularly in the Supplement to the Official Journal of the European Union.
