Supply of electricity for the Walbrzych Energy Cluster Purchasing Group, including for municipal organizational units and companies.1The subject matter of the order is:1.1. supply of electricity to the facilities listed in Appendix No. 3 - description of the subject matter of the order with a demand for electricity over a period of 12 months in the amount of 9,190,361.74 kWh (basic order) 11,028,434.09 kWh (with the right of option +20%),1.2. Execution of activities under the power of attorney, attached to the Agreement.Number of ppe and estimated kWh within the tariff groups: ppe 539, kWh (basic order) 9 190 361.74.The detailed scope of the contract is defined in Appendix No. 3 to the SWZ, in accordance with the provisions of the Act of 10 April 1997. - Energy Law (Journal of Laws of 2022, item 1385, as amended). Other terms and conditions for the execution of the order are set forth in the draft power sales agreement - Attachment No. 8 to the SWZ.The supply of electricity will take place in accordance with the provisions of the Act of April 10, 1997. - Energy Law and in accordance with the implementing regulations issued for this Act, in particular, with the standards of customer service quality set forth in the Decree of the Minister of Climate and Environment dated November 29, 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trade (Journal of Laws .2022.2505 as amended).Electricity is to meet the technical parameters in accordance with the provisions of the Law - Energy Law and its implementing regulations.2. Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the appropriate Distribution System Operator.3. Requirements for the Contractor: performance of activities under the power of attorney, which is an Appendix to the Agreement for the sale of electricity. The Contracting Authority shall grant the successful Contractor a power of attorney to:3.1. notify the relevant Distribution System Operator of the conclusion of the electricity sales agreement and the planned date of commencement of electricity sales,3.2. terminate the existing electricity sales and distribution service agreements (comprehensive agreements) or electricity sales agreements by mutual agreement of the parties to the existing electricity seller and distribution service or electricity seller for all energy consumption points included in Appendix No. 1 to the agreement,3.3. to obtain, if necessary, from the existing seller information on the number, date of conclusion, effective date and termination period of the existing electricity sales contract and distribution service or electricity sales contract,3.4. Representing the Ordering Party before the relevant Distribution System Operator during the process of concluding Distribution Agreements, including signing and submitting on behalf of the Ordering Party an application for the conclusion of a distribution agreement,3.5. Representing the Ordering Party before the Distribution Network Operator in matters related to the conclusion of a distribution service agreement for a new connection (no existing agreement), including signing and submitting on behalf of the customer an application for the connection of a consumer installation to the network,3.6. applying to the Distribution Grid Operator to change the payer, ppe address data, tariff group, contracted power for the electricity consumption points specified in the Annex to the Agreement during the execution of the agreement at the prior request of the Ordering Party,3.7. representing the Ordering Party in contacts with the existing electricity Seller or Distribution System Operator in matters related to the process of changing the Seller, applies to the points included in the Annex to the Agreement.
