Description

1.The subject matter of the order is the supply of brand new spare parts for hoists type WPT-3.0, WPT-3.2, WPT-4.0,WPT-4.0 V5, WP-1.6/C, WPF-3.0, MZN, WNH, WH operating in underground coal mining plants extracting hard coal in areas at risk of methane and coal dust explosion. (2) The subject order is a sector order within the meaning of Article 7 (35) of the PPL Act.3. A detailed description of the subject order is contained in Part III of the SWZZ.
1 The subject of the order is the supply of brand new spare parts for hoists of types WPT-3.0, WPT-3.2, WPT-4.0,WPT-4.0 V5, WP-1.6/C, WPF-3.0, MZN, WNH, WH operating in underground coal mining plants extracting hard coal in areas at risk of methane and coal dust explosion. (2) The contract in question is a sector contract within the meaning of Article 7(35) of the PPL.3 A detailed description of the subject matter of the contract is contained in Part III of the SWZ.4In the event that the Contracting Authority refers in the description of the subject matter of the contract to trademarks, patents or origin, source or a specific process that characterizes the products or services provided by a particular contractor, as referred to in the provision of Article 99 para. 5 of the PPL Act, or references to standards, technical evaluations, technical specifications and technical reference systems referred to in the provision of Article 101(1)(2) and (3) of the PPL Act, the Contracting Authority shall allow the offered solution to meet other requirements, provided that all features, parameters, performance and functionality specified in the ToR are met (equivalent solutions). Therefore, it should be assumed that when in the content of the SWZ (including in the content of the annexes), there are references to such solutions, they are followed by the phrase "or equivalent", and the criteria used to assess equivalence, the Contracting Authority shall indicate each time with a given solution.5In the case where the description of the subject matter of the contract refers to standards, technical evaluations, technical specifications and technical reference systems referred to in the provision of Article 101 (1) (2) and (3) of the PPL Act, if the Contractor refers to equivalent solutions described by the Contracting Authority, he is obliged to prove in his bid, in particular with the help of the means of proof referred to in Article 104-107 of the PPL Act in question, that the proposed solutions meet the requirements specified in the description of the subject matter of the contract to an equivalent degree.6 .. the Contractor shall provide an adequate number of people and resources to carry out the order in an uninterrupted and proper manner.
