The agreement can be concluded at any time and under the same conditions. Interested pharmaceutical companies can request the participation documents (discount agreement, self-declaration of non-existence of exclusion grounds, declaration of conformity) by indicating lot and active substance via the e-mail address mentioned under I.1). Agreements under this model will be concluded between 17.12.2019 and 31.1.2021. Interested parties must submit the fully completed and signed participation documents (self-declaration of non-existence of reasons for exclusion, discount agreement in duplicate, declaration of conformity) by 16.12.2019 for the first time, then by the 15th of each month by post to the office named under I.1). It depends on the access of both AOK PLUS. If the 15th of a month falls on a Saturday, Sunday or national public holiday, such day shall be replaced by the next working day. In case of later receipt (after 16.12.2019 or 15. of a month) the submitted participation documents will be considered on the 15. of the following month. The discount agreement becomes effective on 1.2.2020 if both parties sign until 31.1.2020 inclusive. If the date of signing the AOK PLUS is after 31.1.2020, this discount agreement shall come into force as soon as the AOK PLUS has signed the discount agreement after receipt of the complete documents signed by the pharmaceutical entrepreneur. The signature must be made by the end of the month in which the participation documents must have been received by AOK PLUS. AOK PLUS must organise an advance period of approx. half a month in order to notify the discount agreement. The initial labelling of the discount drugs in the pharmacy software takes place from the second month following the deadline for receipt of the participation documents. This date may vary in the event of changes or new deadlines being set for deadline registrations in the nationwide AOK contract registration portal DatRabatt. A discount agreement shall be concluded with all pharmaceutical companies that meet the conditions for participation and confirm this by signing the requested documents. The contract shall end on 31.1.2021 at the latest, irrespective of the date of conclusion of the contract. AOKPLUS reserves the right to terminate the open-house procedure prematurely, especially in the case of the conclusion of exclusive discount agreements. In this case, contracts already concluded shall terminate in accordance with the provisions of the contract. According to the experience of AOK PLUS, exclusive discount agreements generally come into force 8 to 12 months after the publication of the corresponding tender announcement in the Supplement to the Official Journal of the European Union. The future contractual partners in the open-house model are requested to inform themselves regularly about this in the Supplement to the Official Journal of the European Union.
