Subject of this publication is the conclusion of discount agreements according to § 130a Abs. 8 SGB V for drugs for the active ingredient trastuzumab (ATC code according to WHO: L01XC03) within the framework of a so-called "open-house model". All pharmaceutical companies will be offered the conclusion of a discount agreement pursuant to § 130a (8) SGB V, subject to uniform conditions and a uniform access procedure. An exclusivity is not given. The purchase quantity is unknown at the time the agreement is concluded and depends in particular on the demand of insured persons, the development of the number of insured persons, the prescription behaviour of the contracted physicians and the dispensing and stocking behaviour of public pharmacies. The client does not guarantee minimum purchase quantities.

The agreement can be concluded at any time and on the same terms. Individual contract negotiations are not carried out.

Interested pharmaceutical companies can request the participation documents (discount agreement and the form mentioned under III.2.1) via the e-mail address mentioned under I.1).

Agreements under this model will be closed in the period from 28.12.2018 to 31.1.2020. Interested parties must submit the completed and signed participation documents (self-declaration on the absence of exclusion grounds and discount agreement) for the first time by 27.12.2018, and then by the 15th of each month at the office specified under I.1). It depends on access to the AOK Plus. If the 15th of a month falls on a Saturday, Sunday or nationwide public holiday, the next working day will take the place of such a day. For later entries (after 27.12.2018 or 15th of a month), the submitted participation documents will be taken into account on the 15th of the following month.

Entry documents can be submitted for the first time until 27.12.2018.

The discount agreement comes into effect with the signing of the AOK Plus. The first submission until 27.12.2018 will be signed by the 2nd calendar week 2019. Any discount agreements submitted after 27.12.2018 will be signed by the AOK Plus by the end of the month in which the AOK Plus participation documents must have been received.

Organisationally, it takes approximately half a month for AOK Plus to complete the notification of the discount agreement. The initial labelling of the discount drug in the pharmacy software takes place from the second month following the submission deadline of the participation documents. In the event of changes or redefinitions of the deadlines for the key date reports in the nationwide AOK contract reporting portal DatRabatt, this date may vary.

A discount agreement is concluded with all pharmaceutical companies that fulfil the eligibility requirements and confirm this by signing the requested documents.

The contract ends at the latest on 31.1.2020, regardless of the date of the conclusion of the contract. The AOK Plus reserves the right to terminate the open-house procedure prematurely, especially in the case of the conclusion of exclusive discount agreements. In this case, the contracts already concluded shall terminate in accordance with the contractual provisions. Exclusive rebate agreements usually enter into force eight to 12 months after the publication of the relevant notice of invitation to tender in the Supplement to the Official Journal of the European Union, based on AOK Plus's experience. The future contractors in the open-house model are invited to inform themselves regularly in the Supplement to the Official Journal of the European Union.
