Description

(1) The subject matter of the contract is a banking service regarding the contracting of a loan by the City of Lomza in the amount of PLN 29,000,000.00 to cover the planned deficit of the budget of the City of Lomza in 2023 and repayment of obligations under previously incurred loans. The service of granting the loan is an open-access service with established quality standards, guarded by the Financial Supervision Commission, which supervises the banking sector. (2) Contract mode: open tender under Article 132 of the PPL Act.3. The Contracting Authority provides for the application of the so-called "reverse procedure" referred to in Article 139(1) of the PPL Act, i.e. the Contracting Authority will first examine and evaluate tenders, and then qualify the Bidder whose tender was rated highest in terms of lack of grounds for exclusion and fulfillment of the conditions for participation in the proceeding.4. The Bidder shall be required to pay a bid bond in the amount of PLN 29,000.00 (twenty-nine thousand 00/100 zlotys).
(1) The subject matter of the contract is a banking service for the City of Lomza to take a loan in the amount of PLN 29,000,000.00 to cover the planned deficit of the budget of the City of Lomza in 2023 and repayment of obligations under previously taken loans. (2) A detailed description of the terms and conditions of the loan is contained in Chapter IV of the Terms of Reference, as well as in Appendix No. 1a to the SWZ (Calculation of the total cost of servicing the loan) and Appendix No. 2 to the SWZ (Summary of installment repayment terms). 3 The term of the contract from the date of signing the agreement until 31.12.2037, including: 1) disbursement of the loan by 31.12.2023; 2) repayment of the loan with interest by 31.12.2037. Note: the loan will be disbursed after the signing of the public procurement agreement and in accordance with the rules set forth in this SWZ along with the annexes. The credit will be used in any amounts, dates and tranches on the basis of the Ordering Party's payment instructions. The tranches will depend on the final payment schedules for the execution of the investment.4. The Contracting Authority does not allow for the possibility of submitting partial bids.5. The Contracting Authority does not provide for the award of contracts referred to in Article 214 (1) (7) of the PPL Act.6. Contractors in relation to whom any of the circumstances indicated in Article 108 (1) of the PPL Act or Article 109 (1) (1) (10) of the PPL Act apply are excluded from the procurement procedure.7.Contractors who are not subject to exclusion pursuant to Article 7 (1) of the Act of April 13, 2022 on special solutions to prevent support for aggression against Ukraine and to protect national security (Journal of Laws of 2023, item 129, as amended) may apply for the award.8. as amended).8 The Contracting Authority shall apply the provisions of Article 5k(1) of Council Regulation (EU) No. 833/2014 of July 31, 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU. L. of 2014 No. 229, p. 1 as amended) taking into account Article 5k(2), (3) and (4) of the aforementioned Regulation.9.Pursuant to Article 126 (1) of the PPL Act, before selecting the most advantageous bid, the contracting authority shall call upon the contractor whose bid was the highest evaluated to submit, within a specified period, not shorter than 10 days, up-to-date on the date of submission, the following subjective evidence in order to confirm that there are no grounds for excluding the contractor from participation in the public procurement procedure:a) The contractor's statement, within the scope of Art. 108 (1) (5) of the PPL Act, of not being a member of the same capital group, within the meaning of the Act of February 16, 2007 on competition and consumer protection (Journal of Laws of 2021, item 275, as amended.), with another contractor who has submitted a separate bid, or a statement of affiliation to the same capital group, together with documents or information confirming the preparation of a bid independently of another contractor belonging to the same capital group;b) A copy or information from the National Court Register or the Central Register and Information on Business Activity;c) A statement by the contractor that the information contained in the statement referred to in Art. 125 (1) of the PPL Act;d) Information from the National Criminal Register;e) A certificate from the appropriate head of the tax office;f) A certificate or other document from the appropriate field organizational unit of the Social Insurance Institution, or from the appropriate regional branch or from the appropriate field office of the Agricultural Social Insurance Fund.10Due to the limited number of characters that can be entered in the text of the announcement, the remaining information relevant to the proceedings in question is contained in the ToR and annexes to the ToR, available together with this announcement on the website of the conducted proceedings: https://platformazakupowa.pl/pn/um_lomza.
