1.The subject of the proceedings is the conclusion of a framework agreement for the selection of Licensing Solution Provider (LSP) - intermediaries in the procurement and delivery to the Units of all types of licenses, license upgrades and subscriptions for Microsoft Manufacturer's software, indicated in the Manufacturer's Price List, within the product categories indicated in Annex 1A to the Terms of Reference, or equivalent software, together with technical support, and provision of accompanying services, i.e. expert support services of the Manufacturer and consulting support of the Contractor for the Manufacturer's software.2..The framework agreement specifies all the terms and conditions for the implementation of supplies or provision of accompanying services and the terms and conditions for the selection of Contractors who will implement the supplies or provide services to the Units, from among the Contractors who are parties to the framework agreement.3.The implementation of orders will be carried out successively, after the Unit has carried out the implementation procedure.
1.The subject of the proceeding is the conclusion of a framework agreement for the selection of Licensing Solution Provider (LSP) - intermediaries in the procurement and delivery to the Units of all types of licenses, license upgrades and subscriptions for Microsoft Manufacturer's software, indicated in the Manufacturer's Price List, within the product categories indicated in Attachment No. 1A to the SWZ or equivalent software, together with technical support, and the provision of accompanying services, i.e. expert support services of the Manufacturer and consulting support of the Contractor for the Manufacturer's software.2..The purpose of the framework agreement is to establish the terms and conditions for contracts (executed under executive agreements) that may be awarded during the term of the framework agreement indicated in Chapter IV of the SWZ.3.The framework agreement specifies all the terms and conditions for the execution of supplies or provision of accompanying services and the terms and conditions for the selection of Contractors who will execute supplies or perform services for the Units, from among the Contractors who are parties to the framework agreement.4..Procurement will be carried out successively, depending on the needs of the Units, after the Unit has carried out the execution procedure - i.e., the Unit has submitted a Request for Proposal, the Contractor has submitted a response to the Request for Proposal, and the Contractor has been selected to carry out the contract.5.The list of Units that may award contracts or for which contracts may be awarded is attached as Appendix No. 8 to the SWZ.6.The Procuring Entity shall conclude a framework agreement with a maximum of five Contractors (unless non-rejectable bids are submitted by fewer Contractors) who obtain the highest number of points in the evaluation of bids, based on the criteria set forth in this SWZ, and whose bid price does not exceed the amount allocated to finance the framework agreement, provided that the Procuring Entity may increase this amount. In the event that the balance of points obtained is the same for several Contractors, the Contracting Authority will conclude a framework agreement with all Contractors.7.The subject of executive contracts is the supply under the terms of group licensing (Microsoft Enterprise Agreement (EA) or Microsoft Products and Services Agreement (MPSA) or equivalent) of all types of licenses, license upgrades or subscriptions for Microsoft Manufacturer's software or equivalent software for use by the Units, together with technical support and the provision of Microsoft Manufacturer's or equivalent software expert support services or Contractor's consulting support, for Microsoft Manufacturer's or equivalent software.8.A detailed description of the subject matter of the contract is provided in Attachment No. 2 to the SWZ.9.A list of the categories of products and services subject to executive contracts is provided in Attachment No. 1A to the SWZ - Price Form. The list of Manufacturer's products and the anticipated quantities of products and services listed in Attachment No. 1A to the SWZ - Price Form are indicated for illustrative purposes, based on the planned purchases of the Units, in order to prepare the offer. The Ordering Party indicates that the Units are entitled to purchase any product appearing in the Manufacturer's current price list or any category of services indicated in the Contractor's Price Form. Contractors shall not be entitled to claim to provide supplies and services in the quantities indicated. These quantities are subject to change at the stage of execution of orders by individual Units, provided that the maximum value of the framework agreement is not exceeded.10.The Ordering Party requires that the subject of the contract be provided by a Contractor who is authorized to sell the offered products and provide services:1)having the status of an intermediary in obtaining Microsoft software licenses authorized by this Manufacturer to sell licenses and provide services under group licensing programs (i.e. LSP status)2)in the case of equivalent software - has authorization from the manufacturer to sell the equivalent solution.
