Description
The subject of the contract is the supply of nursing equipment, beds and medical furniture for SP ZOZ "Repty" GCR, as part of the project "Górnośląskie Centrum Rehabilitacji "Repty" - friendly employer" co-financed by the European Social Fund under the Regional Operational Programme of the Silesian Voivodeship for 2014-2020 for the priority axis: VIII. Regional staff of knowledge-based economy, for action: 8.3 Improving access to prevention, diagnostics and therapeutic rehabilitation facilitating employment and return to work, for sub-measure: 8.3.2. Implementation of economic activation through the provision of appropriate health care.
The main objective of the project is to provide an ergonomic working environment for GCR Repty nursing staff by educating them on safe patient lifting and movement and by providing equipment conducive to the elimination of health risks in the workplace related to musculoskeletal overload. The aim of the project is to help eliminate health risk factors in the workplace related to musculoskeletal overload by implementing preventive measures and providing ergonomic equipment for lifting and carrying patients, ergonomic patient beds, bath seats and other equipment functionally adapted to perform care and treatment activities.
The subject of the contract is the delivery of the following equipment:
Part No. 1: Small sliders - 16 sets
Part No. 2: Large sliders - 16 sets
Part 3: Swimming chairs - 12 pieces
Part 4: Test tables - 16 pieces
Part 5: Chairs - 48 pieces
Part 6: Hospital electric beds - 160 pieces
Part 7: Bedside tables - 160 pieces
Part 8: Handling boards - 16 pieces
Part 9: Desk lamps with lighting - 32 sets
A detailed description of the subject of the contract, i.e. the quantities, minimum technical, quality and functional parameters required and the conditions necessary to fulfil them, were specified in Annex 1 to the ToR.
The subject of the contract consists of 9 parts.
6. general requirements concerning the subject matter of the contract:
(a) it shall comply with the requirements for marketing authorisation and use,
b) have the approvals and approvals required by law in accordance with the regulations in force,
(c) it must be brand new, unregenerated, unused, not exhibited at a trade fair, originally packaged and manufactured no later than 12 months before delivery,
d) it must meet the requirements imposed by law concerning admission to trading in the territory of the Republic of Poland, have valid registration documents and certificates required by law in accordance with the Act of 20.5.2010 on medical devices (i.e. Journal of Laws 2017 item 211 as amended),
(e) it must be free from physical and legal defects, in particular without prejudice to any rights of third parties,
(f) it shall be complete and it shall not require the purchase of additional components or accessories in order for it to be put into operation and used as intended,
g) it should be characterized by all technical and operational parameters required by the Contracting Authority as described in Annex 1 to the ToR.
7. the Awarding Entity shall require the subject of the contract to be offered:
a) has been covered by the manufacturer's/supplier's guarantee specified in Annex 1 to the ToR, with a minimum guarantee period of 24 months and, in the case of Section 6, 7, 36 months;
b) has been provided with authorized warranty service for at least 24 months, and in the case of Part no. 6.7 for 36 months, and post-warranty service for at least 10 years provided by an authorized representative of the Manufacturer in Poland (applies to Part no. 3, 4, 6, 7);
(c) the availability of spare parts is ensured for a minimum period of time. 10 years (applies to Parts 3, 4, 6, 7).
In addition, the Contractor shall be obliged to do so:
a) ensure transport of the subject matter of the contract to the seat of the Awarding Entity in such a way as to meet the conditions imposed in this respect by the manufacturer;
b) unloading, assembly and commissioning of the delivered equipment in hospital wards at the Ordering Party's registered office, at the place and on the date indicated by the Ordering Party (applies to Parts 3, 4, 6, 7),
(c) the supply, together with the supply of equipment, of detailed operating and maintenance instructions and warranty cards, as well as a list of authorised service outlets providing services during the warranty and after-warranty period, and a list of suppliers of special spare parts, wear parts or consumables specified by the manufacturer of the product. All the documents referred to above will be provided in the Polish language version. (refers to Parts 3, 4, 6, 7);
d) training of the Contracting Authority's personnel at the place of delivery in the operation and operation of the equipment, including technical and service training. The training shall be confirmed by a protocol and shall be timely enough to allow all Purchaser's shift personnel to be trained. (refers to Parts 3, 4, 6).
9. information on equivalent solutions:
a) If in the description of the subject of the contract (Annex no. 1 to the ToR) the Awarding Entity specifies the subject of the contract by indicating trademarks, patents or origin, source or a specific process that characterises products or services provided by a particular Economic Operator, if this could lead to favouring or eliminating certain Economic Operators or products, it allows for the possibility of submitting equivalent tenders.
b) The above-mentioned definition of the subject matter of the contract is intended solely to assist in the preparation of a tender and is intended to indicate the expected standards as regards the minimum technical parameters of the expected materials and equipment. Equivalent offer should be understood as an offer with technical parameters of strength, quality and performance not worse than the description indicated by the Contracting Authority in the description of the subject of the contract. The parameters indicated by the Ordering Party are minimum and limit parameters. Parameters are understood as functionality, purpose, colouring, structure, materials, shape, size, safety, strength, etc.
c) In connection with the above, the Awarding Entity accepts the possibility of offering materials with different trademarks, patents or origin, but not with other properties and functionalities than those specified in the ToR.
d) A contractor invoking equivalent solutions pursuant to Art. 30 par. 5 of the PPL must demonstrate that the supplies offered meet the conditions specified by the Contracting Authority to a no lesser extent.
e) If the Economic Operator does not submit in the tender documents concerning the use of other materials and equipment, it should be understood that materials and equipment proposed in the description of the subject of the contract were included in the tender price calculation and in the performance of the contract.
f) If the Contracting Authority has used standards, approvals, technical specifications and reference systems referred to in Art. 30 sections 1-3 of the PPL Act in the description of the subject matter of the contract, these should be understood as exemplary. Pursuant to Art. 30 (4) of the PPL Act, the Contracting Authority allows in each case to apply equivalent solutions described in the ToR. Whenever a standard is indicated in this ToR or in the Annexes to the ToR, it shall be assumed that the term 'or equivalent' is used in relation to it.
All documents attached to the ToR, the Economic Operator shall be obliged to read and take into account jointly and in a supplementary manner.
