Description

(1) The subject of the contract is the supply of light fuel oil L-1 - hereinafter referred to as "fuel oil", for heating purposes, depending on the current demand of the Ordering Party, and its successive delivery to the Ordering Party's tanks, according to the orders placed by the Ordering Party, in the total quantity specified in Appendix No. 2 - "Price Form". The maximum volume of one delivery is up to 31 m3.2.L-1 light fuel oil must meet the quality standards specified in PN-C-96024:2011 (Petroleum products - fuel oils) for grade L-1, which should be reflected in the form of a certificate (certificate) of quality provided for each batch of delivery.Minimum parameters that light fuel oil must meet:Calorific value min. 42.6 MJ/kg;Density at 15°C max 860 kg/m3;Flash point above 56°C;Kinematic viscosity at 20°C max 6.00 mm2/s;Sulfur content max 0.1% (m/m).

L-1 light heating oil must meet the quality standards specified in PN-C-96024:2011 (Petroleum products - heating oils) for L-1 grade, which should be reflected in the form of a certificate (certificate) of quality provided for each batch of delivery.3.. L-1 light fuel oil must comply with Polish standards and the Regulation of the Minister of Economy of October 9, 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680), the Regulation of the Minister of Energy of March 1, 2017 on quality testing methods for light fuel oil, heavy fuel oil and inland marine engine oil (Journal of Laws of 2017, item 584), the Energy Law of April 10, 1997 (consolidated text: Journal of Laws of 2019, item 755 as amended). (4) Delivery batch is understood as a single delivery of heating oil of one type and grade delivered to the customer by tanker truck, identified by a shipping document (e.g. proof of pour, proof of issue / certificate) and a certificate (certificate) of quality.5The delivered quantity of fuel oil shall be invoiced in accordance with the volumetric system of fuel sales based on m3 at a reference temperature of 15°C.6. The Contractor shall be responsible for the quality of the delivered fuel oil.7. The minimum parameters to be met by light fuel oil:7.1 Calorific value min. 42.6 MJ/kg;7.2 Density at 15°C max. 860 kg/m3;7.3 Flash point above 56°C;7.4 Kinematic viscosity at 20°C max. 6.00 mm2/s;7.5 Sulfur content max. 0.1% (m/m).8. Fuel oil must be delivered by tanker trucks in accordance with the requirements of PN-91/C-04024, equipped with filler tips with legalized "measurer" in units of measure - liter. Deliveries must be made by specialized tank trucks equipped with valid legalization dispensing equipment - pumps and printers - indicating the exact amount of fuel oil dispensed at the actual and reference temperature of +15°C (dispensing equipment should also have legalization certificates issued by the Office of Weights and Measures).9. Fuel oil will be delivered in compliance with all applicable regulations governing the carriage of hazardous materials according to RID/ADR.10. Fuel oil will be delivered by tank trucks of the contractor at his expense. The price of transportation and filling of the ordering party's tanks is included in the unit price of 1 m3 of fuel oil. The amount of the price of 1 m3 of fuel oil delivered within the scope of the order will be calculated each time in accordance with § 3 of the "Draft provisions of the contract", being Appendix No. 3 to the SWZ.11. Delivery of fuel oil will be carried out successively (in batches) from 7:30 am to 1:00 pm on working days, based on the demand submitted via e-mail by the ordering party.12. The contractor is obliged to carry out the delivery in no more than 2 working days from the date of placing the order by the ordering party.13 .The Ordering Party reserves the right to limit the subject matter of the order during the term of the contract for reasons beyond the control of the Ordering Party, e.g.: weather conditions, and to order smaller quantities of fuel oil than specified in Appendix No. 2 to the SWZ - "Price Form" (the total reduction may not exceed 50% of the initial quantity of the ordered fuel oil).14. The Ordering Party provides for the possibility of options, in accordance with the provisions of Article 441 of the PPL Act.
