Description

(1) The subject of the contract is forest management services as defined in Article 6(1)(1) of the Forest Law of September 28, 1991 (Journal of Laws of 2022, item 672, as amended. - "Forest Act") covering work in the field of silviculture and forest protection, fire protection, timber harvesting and skidding, incidental use of forest, water reclamation and maintenance of forest roads, to be carried out in the area of the Dylewska Mountain Forestry in the Olsztynek Forest District in the year 2023.2. A detailed description of the subject matter of the contract is provided in Chapter 3 of the Terms of Reference, hereinafter referred to as the Terms of Reference, and in Annexes Nos. 2-3 to the Terms of Reference.3The material scopes summarized in the annexes included in Appendix No. 2 to the SWZ are estimates.4 The place of execution of the subject of the contract will be the Dylewska Mountain Forestry in the administrative area of the Olsztynek Forest District,
The subject matter of the order shall be forest management services as defined in Article 6.1.1 of the Forest Act in the Dylewska Mountain Forestry District (08) - Package No. 4.2. The material scope of the subject matter of the order shall include the total amount of work in the field of silviculture and forest protection, fire protection, timber harvesting and skidding, incidental forest use, water reclamation and maintenance of forest roads, resulting from the annexes included in Appendix No. 2 to the SWZ.3.The material scopes summarized in the annexes included in Appendix No. 2 to the SWZ are estimates.4. The quality standards relating to all essential features of the subject of the contract are specified in the annexes included in Appendix No. 3 to the SWZ.5.Descriptions of activity codes describing individual forestry works (activities) included in the subject matter of the contract are described in Annex No. 3 to the SWZ.6. Description of the rules of procedure for the acceptance of forestry works is included in Annex No. 3 to the SWZ.7.Due to the actual natural and weather situation that may arise during the execution of the subject matter of the contract, as well as the unforeseen economic situation at the moment, the Contracting Authority reserves the right to make decreasing adjustments, increasing adjustments, setting new locations, as well as stopping the execution of activities indicated in the individual lines of the tables describing the subject matter of the contract. Increasing adjustments do not mean the introduction of new work, not included in the scope of the order, and decreasing adjustments do not mean the complete abandonment of part of the work. They should be understood as an increase in the amount of work in one location (forest address) in the Package Execution Area (including locations in the Package Execution Area not initially indicated in the SWZ), while decreasing the amount of work in another location (forest address) in the Package Execution Area, within the total amounts of individual works included in the scope of the Subject of the Contract specified in the SWZ, falling to be performed in the entire Package Execution Area. The necessity to increase the size of certain elements of the executed order in the course of execution of the contract subject may also occur in order to complete the full scope of work described in the contract subject. Determination of the new location shall be carried out within the scope of the subject of the contract, but always only in the Package Execution Area.8. In the case of mandatory exclusion of positions from harvesting in the machine system (timber harvesting on cutting positions on which the use of multi-operational machines is not allowed) in particularly justified cases, such as changes in the conditions for which the above activities have been established, the Contracting Authority shall allow a change in harvesting technology. Justification shall be presented to the Contractor in each case.9. The Contractor shall perform the subject of the contract on the basis of written orders submitted by the Employer's Representatives ("Order"). The content of the Order is specified in the draft provisions of the contract - Annex to the SWZ.10. The Contractor shall be obliged to clean up the residue from the harvesting work from roads, surface dividing lines, ditches, etc. objects, as well as the remaining waste from his own activities (garbage, empty packaging, used machine parts, etc.).
