Description

The subject of the contract is forest management services as defined in Article 6, paragraph 1, item. 1 of the Act of September 28, 1991 on Forests (unified text: Journal of Laws of 2023, item. 1356 - "Forest Act") covering work in the field of silviculture and forest protection, fire protection, timber harvesting and skidding, and forest nursery management at the Nursery Farm in Krępsk, chemical plant protection on the Goleniów Forest District's territory, as well as services in the field of harvesting cones from lying trees for the Nursery Farm in Krępsk to be performed on the Goleniów Forest District's territory in the years 2024 and 2025.
The subject of the contract is forest management services as defined in Article 6, paragraph 1, item. 1 of the Act of September 28, 1991 on Forests (unified text: Journal of Laws of 2023, item 1356 Forest Act) covering works in the field of silviculture and forest protection, fire protection, logging and skidding to be performed on the territory of the Goleniów Forest District in Zielonczyn, Dzisna and Borowik forest districts in the years 2024-2025. The Ordering Party, in accordance with Art. 95 of the Polish Public Procurement Law requires the employment by the Contractor or subcontractor on the basis of an employment relationship of persons performing activities within the scope of the contract involving the harvesting and skidding of timber, if the performance of these activities involves the performance of work as specified in art. 22 § 1 of the Act of June 26, 1974. - Labor Code (consolidated text: Journal of Laws of 2023, item 1465, as amended). The material scope of the subject of the contract includes the total quantities of work in the field of silviculture and forest protection, fire protection, logging and skidding specified in Appendix No. 2 to the SWZ. The quantities of works included in the scope of the Subject of the Contract, indicated in the SWZ, are estimates. The amount of work ordered to be performed during the execution of the Subject of the Agreement may be less than the amount presented in the SWZ, which, however, cannot be the basis for any claims by the Contractor against the Ordering Party regardless of their legal basis. The Ordering Party may order during the execution of the Contract a scope of work smaller than that indicated in the SWZ, but not less than 70% of the Value of the Subject of the Contract. The Contracting Authority will provide the Contractor with the detailed scope of work by group of activities and locations for the year 2025 before the commencement of the work in the following year, i.e. after the approval of the provisional financial and economic plan by the end of the year preceding the next year of work implementation. Descriptions of the activity codes describing the individual forestry works (activities) included in the subject matter of the contract, as well as a description of the rules of procedure for the acceptance of forestry works are included in Appendix 3 to the SWZ.
