Description
The subject of the contract is forest management services as defined in Article 6, paragraph 1, item. 1 of the Forest Act of September 28, 1991 (unified text: Journal of Laws of 2023, item 1356 - "Forest Act") to be performed on the territory of the Miroslawiec Forest District in the year 2024. The proceeding is conducted as an open tender on the basis of Article 129 paragraph 1 item 1) in connection with Article 129 paragraph 2 and Articles 132-139 of the Act of September 11, 2019. Public Procurement Law (consolidated text: Journal of Laws of 2023, item 1605 - "PPL") and implementing acts to the PPL. The proceeding shall be conducted in accordance with the rules provided for classic contracts with a value equal to or exceeding the EU thresholds. The proceeding is conducted in accordance with the rules provided for the so-called "reverse procedure" referred to in Article 139 paragraphs 1, 3 - 4 of the PPL.
The subject of the contract is forest management services as defined in Article 6, paragraph 1, item. 1 of the Act of September 28, 1991 on Forests (unified text: Journal of Laws of 2023, item 1356 - "Forest Act") covering works in the field of silviculture and forest protection, fire protection, timber harvesting and skidding and tourist management, grassland and agricultural management, seed and selection, incidental forest use and maintenance of forest roads, fire accesses, to be performed on the territory of the Mirosławiec Forest District in the year 2024 in the forest districts of Orle, Łowicz, Mirosławiec.The material scope of the subject matter of the order includes the total quantities of work in the field of silviculture and forest protection, fire protection, timber harvesting and skidding and tourist management, meadow and agricultural management, seed and selection, incidental forest use, and maintenance of forest roads, fire accesses, resulting from Appendix No. 2 to the SWZ for a given Package, which consists of: Annex No. 2.1. - planned size of work; Annex No. 2.2. - detailed size of work by group of activities, actions and locations; Annex No. 2.3.1. - characteristics of forestry in terms of timber harvesting;Annex No. 2.3.2. - sorting arrangement of timber harvesting in forestry;Annex No. 2.3.3. - summary of timber skidding distances and conditions;Annex No. 2.3.4. - Statement of items with additional impediments to harvesting and skidding;Annex No. 2.3.5. - statement of items not available for machine harvesting;Annex No. 2.3.6. - information on optimal harvesting technology (potential);Annex No. 2.4.1. - information on the nature of forest tending (zones for weed mowing);The material ranges compiled in the annexes included in Annex No. 2 are estimates. Quality standards relating to all essential features of the subject matter of the contract are set forth in Appendix 3 to the SWZ. The Contracting Authority, in accordance with Article 95 of the Polish Public Procurement Law, requires employment by the Contractor or subcontractor on the basis of an employment relationship of persons performing activities within the scope of the contract involving the harvesting and skidding of timber, if the performance of these activities involves the performance of work as specified in Article 22 § 1 of the Act of June 26, 1974. - Labor Code (consolidated text: Journal of Laws of 2023, item 1465).
