Description

This notice is not an open procedure, but an approval procedure (so-called open house procedure). For reasons of transparency, the approval procedure and its conditions are published in the European Official Journal.The subject of the procedure is the approval of contractual partners for the operation of alarm transmission systems for the connection of fire alarm systems in the area of the Traunstein Integrated Control Centre. Within the scope of the present procedure, all suitable interested parties are offered the conclusion of a provider contract at any time, i.e. even after the initial start of the contract, subject to uniform contract conditions.
According to Art. 2 Para. 2 ILSG, the Integrated Control Centre has the sovereign task of receiving fire alarm systems for fire brigade alerting, the installation of which is prescribed or ordered according to a public law regulation (necessary fire alarm systems) and for which the connection to the responsible alarm triggering point is prescribed.In order to fulfil this task, the special-purpose association plans to conclude non-exclusive contracts with one or more third parties as providers for the operation of an alarm transmission system - AÜA - for the connection of fire alarm systems.The admission of the operators to the operator contract which is the subject matter of the proceedings takes place within the framework of a so-called open-house procedure.This is not a classical award procedure, but a pure admission procedure. According to the case law of the European Court of Justice, pure approval procedures are not subject to public procurement law, as there is no competition due to the lack of a selection decision. The special-purpose association as contracting party does not itself make any decision on the selection of the contracting parties. Individual contract negotiations are not conducted. A contract is concluded with all applicants who meet the requirements for the contract and prove this by means of the required self-declarations and evidence.
