Description

The subject of the contract is the delivery of a brand new pressure car (year of production 2020).2 The lease period - 48 months, during which the Ordering Party (lessee) will pay 47 monthly lease instalments to the Contractor (lessor).3 Detailed scope and description of the subject of the contract is contained in the ToR with annexes available on the Ordering Party's website www.bpk.pl.
The subject matter of the contract is the delivery of a brand new pressurised car (production year 2020) under operating lease.2. the Contractor shall deliver the subject matter of the contract to the Principal's registered office at ul. Zabrzańska 1, Bytom (Śląskie Voivodship, Poland) at its own expense on the date agreed upon by the parties. Technical acceptance of the subject of the contract shall take place at the Contractor's premises in the Republic of Poland within one month before the final acceptance of the subject of the contract. 4. The pressure vehicle delivered by the Contractor must have a valid approval certificate issued in accordance with the applicable law or a set of documents necessary for registration as a special vehicle, including unit approval issued by Transport Technical Inspection by way of an administrative decision. The original certificate of approval must be submitted with the delivery of the vehicle. It is allowed to have a valid European "Vehicle Type Approval Certificate" in accordance with the applicable regulations and it is allowed to have other documents that allow the delivered vehicle to be put into circulation and enable the registration formalities to be carried out.5 The framework requirements concerning guarantee, quality, service authorization, training equipment, documentation and software for the subject of the order are specified in Annex 8 to the ToR.6 The method of financing. a) binding method of financing an operating lease contract within the meaning of the Corporate Income Tax Act of 15 February 1992 (i.e. Journal of Laws of 2019, item 865); b) leasing period - 48 months, during which the Ordering Party (lessee) pays 47 monthly leasing instalments to the Contractor (lessor). The lease installments will be determined at a fixed interest rate and will be paid monthly, on the date specified in the lease payment schedule being an integral part of the agreement. In order to calculate the offer, the Contractor shall be obliged to accept a fixed WIBOR 1M rate from the day of tender announcement; c) the Ordering Party shall pay the initial fee in the month following the vehicle's final acceptance, confirmed by an acceptance protocol signed by the Ordering Party and the Contractor; d) the initial fee: 5 % of the net value of the leased item;e) final fee (purchase fee): 6 % of the net value of the leased item;f) currency of the lease agreement - PLN. All price indices included in the lease payment schedule must be given in Polish zloty;g) the Ordering Party does not expect any additional costs of the lease agreement. The lease installment shall include all costs related to the performance of the lease agreement including, among others: commissions, handling and other bank fees, registration costs as well as fees resulting from the Act of 12 January 1991 on local taxes and fees (i.e. Journal of Laws of 2019, item 1170 as amended). The Contracting Authority does not allow for re-invoicing of any additional costs of the execution of the subject of the contract, in particular the costs listed in the previous sentence.7 The Contracting Authority informs the Contractor that it will insure the vehicle on its own. 8. The Contracting Authority informs that it accepts standard security of the contract in the form of a blank promissory note together with a promissory note declaration.
