Description

The subject of the contract is the delivery of a diagnostic microscope with equipment (i.e. a set consisting of a microscope and a camera with software - 2 pcs.), hereinafter referred to as "the equipment" or "the subject of the contract", meeting the requirements specified in a detailed description of the subject of the contract, constituting Appendix No. 2 to the ToR. The offered subject of the contract should be brand new, come from current production (production in 2018-2019) and have appropriate certificates and approvals allowing the device to be sold and used in the territory of the Republic of Poland. The Contractor is obliged to provide free of charge authorized warranty service.2 The scope of the contract includes: purchase of the subject of the contract with its delivery to the Customer, unloading, bringing to the place indicated by the Customer, as well as installation and full installation of the system with equipment and training of the Customer's staff in the use of the microscope (training of the Customer's staff in accordance with the provisions of the model contract - Appendix No. 3 to the ToR).3. The completion date is a non-price criterion for the evaluation of offers - in case of offering shorter than the maximum permitted completion date, the Economic Operator's offer will receive additional points, in accordance with the rules specified in chapter XI of the ToR.4. Delivery address: University of Silesia in Katowice, Faculty of Biology and Environmental Protection, Department of Microbiology, Jagiellońska Street 28, 40-032 Katowice, POLAND5. Required minimum warranty period for the offered microscope and camera with software: 24 months. The warranty period is a non-price criterion for evaluating offers - in case of offering a warranty period longer than the minimum required, the Contractor's offer will receive additional points, in accordance with the rules specified in chapter XI of this ToR.6: 3 working days after the defect is reported. The response time of the service means the time of starting the removal of the defect, counted from the date of sending the Contractor the notification of the defect by e-mail or fax. The arrival of the service technician, certified by the user, the diagnosis and the commencement of the repair are acknowledged as the start of the defect rectification. The response time of the service is a non-price evaluation criterion for tenders - in the event of offering shorter than the maximum permissible time, the Economic Operator's offer will receive additional points, in accordance with the rules set out in chapter XI of the ToR.7. Detailed conditions of contract performance and payment conditions are included in the model contract attached as Appendix No. 3 to the ToR.8. The Awarding Entity does not allow for the possibility of submitting partial tenders.9. The Awarding Entity does not allow for the possibility of submitting variant tenders.10The Contracting Authority does not provide for the award of contracts for additional deliveries within the meaning of Article 67 paragraph 1 point 7 of the PPL.11 Act. If the Economic Operator intends to carry out the subject of the contract with the participation of subcontractors, the Contracting Authority requests that the Economic Operator indicates the part of the contract which it intends to entrust to subcontractors and the companies of such subcontractors (in accordance with paragraphs 5 and 6 of the offer form - Annex 1A to the ToR). If the Economic Operator does not indicate in the offer the part which he intends to entrust to subcontractors, the Contracting Authority will assume that the Economic Operator will carry out the order himself.12 The Contracting Authority does not reserve the obligation for the Economic Operator to personally carry out works related to the placement and installation of the subject matter of the contract.
