Description
1.The subject of the contract is: supply of active electricity for the company Mazowiecki Port Lotniczy Warszawa-Modlin Sp. z o.o., which shall be carried out under the terms and conditions set forth in the Act of April 10, 1997 Energy Law (Journal of Laws 2022, item 1385, as amended), hereinafter referred to as the Energy Law, the applicable regulations issued on its basis, in accordance with the rules set forth in the licenses, provisions of the Supply Contract, terms and conditions contained in this Specification of Order Terms (hereinafter referred to as the SWZ) and any clarifications provided by the contracting authority in the course of the tender proceedings. Mazowiecki Port Lotniczy Warszawa-Modlin Sp. z o.o. is a final customer within the meaning of the Energy Law.2.The expected amount of energy to be supplied during the term of the contract in B23 tariffs for two PPE points is 5,600.00 MWh.3.In accordance with Article 433, paragraph 4 of the Public Procurement Law, the minimum level of performance is -15% of the total volume of the contract.
1.The subject of the contract is the supply of electricity to two connections of the Ordering Party. The quality standards for the subject matter of the contract are contained in the Decree of the Minister of Economy dated March 22, 2023 on detailed conditions for the operation of the electric power system (Journal of Laws 2023, item 819, as amended). The amount of electricity is the estimated demand of the Ordering Party and amounts to a total of 5,600.00 MWh. 2.The indicated Quantity of energy does not constitute an obligation of the Ordering Party to consume and purchase. The use of electricity at a lower level cannot be the basis for any claims. 3.The amount of energy expected to be delivered during the term of the contract in B23 tariffs for two PPE points is 5,600.00 MWh.4.The indicated amount of electricity specified in paragraph 3 shall not constitute an obligation of the Ordering Party to consume and purchase. The Purchaser reserves the right to reduce the total amount of electricity purchased due to reduced consumption of electricity in an amount corresponding to the actual demand of the Purchaser, regardless of the estimated forecast of electricity consumption.5.In accordance with Art. 433, para. 4 of the Public Procurement Law, the minimum level of performance is -15% of the total volume of the contract.6.The Ordering Party will purchase in tranches during the period from the date of conclusion of the contract. At the disposal of the Ordering Party will be quotations of the indices BASE_Y-24 and BASE_Q-XX-24 on the Towarowa Giełda Energii S.A.The Ordering Party may make an order with a maximum of 4 tranches for each quarterly period, with the percentage size of each tranche being a multiple of 25% and ranging from 25% to 100% of the Ordering Party's volume for a given period. 7.The form of ordering tranches (online tool provided by the Contractor or other form of notifications) will be determined by agreement. The Ordering Party will be able to purchase tranches until at least the 20th of the month preceding the delivery period. The date will be agreed upon by agreement. The Ordering Party will purchase tranches until 10:00 a.m. or 12:00 p.m., which will be determined by agreement at the contract conclusion stage. The tranche will be executed at the price of DKR - the daily settlement rate for the day of the tranche request.7.The tranche will be executed if the number of contracts for the product is for the index BASE_Y-24 3 MW,. for the index BASE_Y-24 and a for BASE_Q-XX-24 2 MW.8.The price of energy for a given month will be determined on the basis of consumption and weighted average of purchased tranches for the month taking into account the percentage of ordered volumes. The energy price of non-ordered tranches shall be determined for each month separately in the amount of the arithmetic average of TGe24 indices published on the DAM market of the Polish Power Exchange S.A. in the month of energy delivery.The value of the order will be determined according to the formula:E * CET, where:CET = CPM + KPOZ + A + WP * (CTGE); where:CET - Net electricity sale price;CPM - unit cost of obligations (i.e., green certificates, blue certificates, white certificates, i.e., obligations under Art. 59 item. 1 and 2 of the Law of February 20, 2015 on Renewable Energy Sources and Article 10 (2) of the Law of June 11, 2016 on Energy Efficiency);CET - other costs (margin, trade balancing, transaction fees, cost of profile variability, other costs of the Contractor);A - excise tax;WP - profile factor resulting from demand balancing;CTGE - estimated price of energy from the net wholesale market based on quotations of the Polish Power Exchange S.A.9.The Contractor will be obliged to sign an agreement with the relevant DSO at the latest before the commencement of supply and in accordance with the procedures of the Energy Law. cd in point II.2.14) Additional information
