The subject of the contract is the comprehensive supply of electricity in 2024, consisting of the sale and distribution service of electricity for facilities owned by the Municipality of Trzebownisko and for road lighting. The electricity consumption given in the list of facilities (Appendices No. 1, 2, 3 to the SWZ) and accepted for the contract is indicative only, serving only to calculate the estimated value of the contract and compare bids. It does not constitute an obligation for the Procuring Entity to purchase electricity in the specified amount. (2) Settlement of obligations arising from the sale of electricity will take place according to the indications of metering and billing systems. The sale of electricity will take place in accordance with the provisions of the Energy Law of April 10, 1997 ( Journal of Laws of 2022, item 1385, as amended) by implementing regulations to this Act, in particular, the Decree of the Minister of Economy of March 22, 2023 on detailed conditions for the operation of the electric power system (Journal of Laws of 2023, item 632), the Decree of the Minister of Climate and Environment of November 29, 2022 on detailed rules for shaping and calculating tariffs and settlements in electricity trade (Dz. U. item 2505 and item 226 of 2023, as amended), with the rules set forth in the licenses, the provisions of the SWZ, and the price of electricity presented in the bid, as well as with the prices of distribution parameters in accordance with the current tariffs of the distribution network operator, approved by the President of the Energy Regulatory Office, with which the Contractor has a contract for the provision of distribution services. (3) The billing period shall be a bimonthly period. Settlements for the distribution of electricity will be made on the basis of current indications of metering and billing systems according to the fee rates resulting from the submitted offer and the Tariff of the Distribution System Operator, the Seller's Tariff. The Contractor, when submitting a bid, must have an agreement for the provision of electricity distribution services with a distribution system operator operating in the territory of the Ordering Party or a statement that he has an agreement with a Distribution System Operator allowing for the provision of electricity distribution services to the Ordering Party's facilities or a statement that he ensures the conclusion of such an agreement. The quality standards referred to in Article 246 (2) of the PPL are set forth in the Energy Law, as well as in implementing acts and Polish standards. (5) The Ordering Party shall grant the Contractor the power of attorney to terminate the existing contracts for the sale and distribution of electricity within the framework of the applicable regulations and to the extent mutually agreed upon by the Ordering Party and the Contractor.
