Description

A detailed description of the technical parameters and requirements of the Awarding Entity concerning the subject matter of the contract is included in Annex 1 to the ToR.3As part of the contract, the Contractor is obliged to sell (supply) electricity to the power consumption points listed in the table in Annex 1 to the ToR, in accordance with the provisions of the Energy Law of 10.4.1997 (i.e. Journal of Laws of 2020, item 833, as amended), implementing acts to this law and instructions of the power system operators (TSO and DSO).4 The Contracting Authority has comprehensive contracts for all points described in Annex 1 to the ToR. Termination of the comprehensive agreements shall be effected by the Contracting Authority. The contract for the provision of distribution services shall be concluded by the Ordering Party before notification of the conclusion of a new contract for the sale of DSOs.
This order does not cover issues related to the distribution of electricity connection, metering and quality of energy included in separate contracts for the provision of distribution services to be concluded by the recipient with the Distribution Network Operator.2 The Contractor, on the basis of the power of attorney granted by the Ordering Party, will report to the relevant authorities of the Distribution Systems on its behalf the concluded sales contracts in the area of electricity consumption. The form of the power of attorney will be previously agreed with the Ordering Party.3. The forecast amount of electricity that the Ordering Party intends to purchase during the term of the agreement is 177 480 kWh. The actual amount of purchased electricity will result from the current needs of the Ordering Party during the execution of the agreement. The estimated demand for electricity is only indicative and serves to compare offers and in no way constitutes an obligation on the part of the Awarding Entity to purchase electricity in the stated amount. The amount of electricity consumed by the Contracting Authority will be determined on the basis of measurement and settlement data provided by the DSO. A possible change in the estimated consumption will not result in additional costs for the Contracting Authority, apart from billing for the actually consumed amount of energy at the prices specified in the contract. The Contractor shall not be entitled to any claim for the Ordering Party's failure to collect the anticipated amount of energy.4. The actual amount of electricity sold to the Ordering Party by the Contractor shall be settled in electricity units dedicated to tariff groups, respectively, on the basis of measurement and settlement data provided to the Contractor by the DSO in a given settlement period.5The net unit price shall include all costs of order execution, such as: excise duty, costs of commercial balancing service, costs of changing the seller.6 Settlements between the Ordering Party and the Contractor shall be made only in Polish currency. The Contractor shall determine the price in Polish currency. The Contractor, whose settlement currency is a currency other than PLN, is obliged to convert the foreign currency, based on the average exchange rate of the National Bank of Poland (table A), as of the date of publication of the announcement in the Official Journal of the EU.7 The Ordering Party reserves the right to change the number of electricity points due to the sale of properties, buildings or flats, disconnection or connection of new properties, buildings or flats and changes in the tariff group.8 If the Ordering Party has doubts as to the correctness of the contract execution, it shall require the Contractor to present a report on its execution.
