1 The subject of the contract is: "Supply of electrical materials" divided into two Parts.
1 The subject of the order is: "Supply of electrical materials" divided into two Parts, for tasks carried out under: A. Project entitled: - "Improving energy efficiency of heat transmission through modernization of district heating networks STAGE 1" (POIS.01.05.00-00-0008/16-00), co-financed by the European Union from the Cohesion Fund under the Operational Program Infrastructure and Environment 2014-2020, Priority Axis I: Reducing the emissivity of the economy, Measure: 1.5. Efficient distribution of heat and cold. - "Construction of new networks, connections and nodes to new facilities" (POIS.01.06.02-00-0018/16-00), co-financed by the European Union from the Cohesion Fund under the Operational Program Infrastructure and Environment 2014-2020, Priority Axis I: Decreasing the emissivity of the economy, under Measure 1.6. Promoting the use of high-efficiency cogeneration of heat and power based on the demand for useful heat, Sub-measure: 1.6.2 District heating and cooling networks for high-efficiency cogeneration sources. B. Current activities of MPEC - Rzeszów Sp. z o.o. (hereinafter referred to as "current activities"). Part 1 Delivery of bipartite casing pipes - 20% of the subject matter of the order will be carried out under the OPI&E Projects, and 80% of the subject matter of the order will be carried out under the current activities. (2) The details of the subject of the order and its scope are specified in Appendix No. 1 to the SWZ (Form "Offer"). 3) The materials constituting the subject of the order must be brand new, unused, i.e. manufactured no earlier than 6 months before the date of their delivery to the Purchaser. 4.Materials constituting the subject of the contract must: 4.1. be brand new, unused, i.e. manufactured not earlier than 6 months before the date of their delivery to the Purchaser, 4.2. meet the requirements provided in: - The Act of April 16, 2004 on construction products (consolidated text, Journal of Laws of 2021, item 1213), together with implementing regulations to this Act, - The Act of August 30, 2002 on the conformity assessment system (consolidated text, Journal of Laws of 2023, item 215), - Regulation (EU) No. 305/2011 of the European Parliament and of the Council of March 9, 2011 establishing harmonized conditions for the marketing of construction products and repealing Council Directive 89/106/EEC. 4.3. correspond, in terms of quality, to the requirements of products permitted for marketing and use in construction pursuant to Article 10 of the Act of July 7, 1994 Construction Law (consolidated text Journal of Laws of 2021, item 2351, as amended), hereinafter referred to as the Construction Law. 4.4 Have the relevant documents, i.e. safety mark certificate, attestations, declarations of conformity with the standard or technical approval (concerning construction products placed on the market before July 1, 2013) or copies of the declaration of performance in accordance with the Regulation of the European Parliament and of the Council (EU) No. 305/2011 (concerning construction products placed on the market after July 1, 2013). 5 The required period of quality warranty for the subject of the contract: 24 months counting from the date of their protocol acceptance. Warranty in accordance with the conditions specified in Chapter XIX of the SWZ. (6) Other terms and conditions of the Ordering Party relating to the subject matter of the contract are set forth in Chapter XIX of this SWZ "IMPORTANT PROVISIONS OF THE PUBLIC CONTRACT AGREEMENT". 1 The subject of the contract is: "Supply of electrical materials" divided into two Parts, Part 2. Supply of batteries - implemented as part of current activities - Annex No. 2 to the SWZ. This is a supply contract with the numerical code of the Common Procurement Dictionary: CPV 31000000-6 Electrical machinery, apparatus, equipment and products; lighting CPV 44160000-9 Pipelines, piping, pipes, pipe linings and similar items 2. The details of the subject of the order and its scope are specified and Annex No. 2 to the SWZ (the "Bid" form). 3.Materials constituting the subject of the order must be brand new, unused, i.e. manufactured no earlier than 6 months before the date of their delivery to the Purchaser. 4.Materials constituting the subject of the contract must: 4.1. be brand new, unused, i.e. manufactured not earlier than 6 months before the date of their delivery to the Purchaser, 4.2. meet the requirements provided in: - The Act of April 16, 2004 on construction products (consolidated text, Journal of Laws of 2021, item 1213), together with implementing regulations to this Act, - The Act of August 30, 2002 on the conformity assessment system (consolidated text, Journal of Laws of 2023, item 215), - Regulation (EU) No. 305/2011 of the European Parliament and of the Council of March 9, 2011 establishing harmonized conditions for the marketing of construction products and repealing Council Directive 89/106/EEC. 4.3. correspond, in terms of quality, to the requirements of products permitted for marketing and use in construction pursuant to Article 10 of the Act of July 7, 1994 Construction Law (consolidated text Journal of Laws of 2021, item 2351, as amended), hereinafter referred to as the Construction Law. 4.4 Have the relevant documents, i.e. safety mark certificate, attestations, declarations of conformity with the standard or technical approval (concerning construction products placed on the market before July 1, 2013) or copies of the declaration of performance in accordance with the Regulation of the European Parliament and of the Council (EU) No. 305/2011 (concerning construction products placed on the market after July 1, 2013). 5 The required period of quality warranty for the subject of the contract: 24 months counting from the date of their protocol acceptance.
