Description
The subject of this tender procedure is the supply of an as yet unspecified number of antigen tests for self-administration by laypersons (self-tests) to detect the presence of infection with SARS-CoV-2 in accordance with the specifications. A framework contract is to be concluded with fixed weekly call-off quantities in the 17th - 22nd week of 2021 for 3.1 million antigen self-tests and a minimum purchase of 2 million antigen self-tests per week in the 23rd and 24th weeks of 2021. For periods after the end of the 24th week of 2021, there are no minimum purchase obligations on the part of the contracting authority and its end-use sites. However, at any time during the term of the contract, the contractor shall ensure that it is able to supply up to 3 100 000 antigen self-tests per week on call. The framework agreement has a basic term until 31.7.2021 and can be extended to a maximum of 31.12.2021.The subject of the contract is also the timely delivery of the antigen self-tests to a total of up to 6,200 end-use points in the state of NRW, i.e. schools, authorities and other facilities of the client. The delivery obligation of the contractor begins with the 17th week, i.e. with 26.4.2021.

A framework contract is to be concluded with fixed weekly call-off quantities in calendar weeks 17 - 22 of 2021 for 3.1 million tests and a minimum purchase of 2 million tests per week in calendar weeks 23 and 24 of 2021. For periods after the end of calendar week 24 2021, there are no minimum purchase obligations on the part of the customer and its end-use sites. However, at any time during the term of the contract, the Contractor shall ensure that it can deliver up to 3 100 000 tests per week on call.The only tests to be delivered in accordance with the contract are those which, at the time of the order and delivery, have a special approval in accordance with Section 11 (1) of the German Medical Devices Act (MPG) by the Federal Institute for Drugs and Medical Devices (BfArM) and are listed under a corresponding BfArM-AT number or have undergone a conformity assessment procedure in accordance with Regulation (EU) 2017/745 on medical devices or Regulation (EU) 2017/746 on in vitro diagnostic medical devices and can prove this by means of a CE declaration of performance, but excluding tests to be used exclusively nasopharyngeally.The subject matter of the contract is also the timely delivery of the antigen self-tests to the total of up to 6,200 end-use points in the State of North Rhine-Westphalia, i.e. schools, authorities and other institutions of the contracting authority. The delivery obligation of the Contractor shall commence with week 17 of the year 2021, i.e. with 26.4.2021.From week 23 onwards, the Contractor's contractual services shall also include - if offered - the processing of individual orders of the end user locations via an existing ERP system with logistics module and the provision of a web-based ordering platform that is generally accessible 24/7/365 with a reliability of >99% with two-factor authentication or login data for accredited ordering parties, via which the end user locations can place individual call-off orders under this framework agreement with a minimum order quantity of 100 tests each. A web-based tracking of the order and delivery processes with self-recall on the Internet as well as a daily overview of the delivery and invoice status must also be ensured - if offered. If the Contractor cannot provide its own ordering platform, integration into the "NRW Purchasing Catalogue" must be ensured. Individual call-offs of the end-user points are transmitted to the contractor from the "NRW Purchasing Catalogue" in the form of HTML e-mails. At the request of the contractor, the e-mails can also be extended to include an electronically processable XML file in accordance with the OpenTrans standard as a file attachment. The Contractor shall provide the templates (product description, etc.) required for the integration of the contractual products into the Purchasing Catalogue.The contractual services of the Contractor also include the short-term delivery of the contractual products DDP (Delivered Duty Paid) to the respective end-use points in accordance with the individual call-offs made by these.With regard to the further details, reference is made to the service description and the framework agreement.
