The supply is put out to tender in 3 lots and is for 12 months from 01.01.2024 to 31.12.2024 with three renewal options for one year each until 31.12.2027 at the latest:Lot 1: Cleaning and care products, cleaning accessoriesLot 2: Vermop cleaning equipmentLot 3: Hygiene material and dispenser rental contract with option to take over ownership
1. scope of servicesThe offer includes the delivery of cleaning and care products + cleaning accessories free to destination.2. pricingIn principle, a price calculation shall be based on the annual quantities specified in the bill of quantities. Quantities may be exceeded or fallen short of, as this is not a classic call-off contract but a framework agreement in accordance with § 21 VGV, in which only the conditions for the individual orders during the contract period and the price are specified. The orders placed by the individual municipal departments are based on actual demand. The products can be called off individually. It is not permissible to discontinue delivery if the specified quantities are reached before the end of the contract.The permissible container sizes are specified in the specifications. The bidder shall enter the container sizes offered by him in the column provided for this purpose. Prices shall be quoted net for the specified unit. The prices offered must be binding for the first contract year. Cancellation at the end of the first contract year is possible for the customer and bidder. A period of notice of 6 months must be observed.price adjustments may be asserted from the 2nd year of the contract. These are permissible provided that the bidder can prove that it cannot maintain its bid prices because its supplier(s) has/have previously effectively increased prices to it. An examination for price adjustment requires the consent of the customer. The new price agreed in this way shall then be valid for at least another 12 months. If no agreement is reached on the new prices, the contract shall be deemed terminated with 3 months' notice. The contract prices shall also include, among other things, the financial effects arising from the application of the Gütergefahrenverordnung Straße (German Road Freight Danger Ordinance) from other statutory or other regulations already in force or to be expected for the delivery period.price discounts in the event that several or all lots are combined shall not be taken into account in the bid evaluation. However, they shall remain part of the offer and shall become part of the contract if the order is placed.3. QualityDuring the contract, the bidder shall guarantee consistent quality (as offered and, if applicable, sampled). If the specified product is no longer available, the bidder may use an alternative product only with the written consent of the customer. If deviations from the products offered are discovered after the order has been placed, the client reserves the right to withdraw from the contract immediately. In this case, the bidders undertake to pay for any damages and financial disadvantages incurred by the City of Lahr.4. Order Processing / Controlling SoftwareThe bidder shall provide the necessary software for written ordering (for 4 PC workstations) as well as the software for inventory management and overview of the items already ordered for the current year and previous year for at least 200 items. All orders must be visible in retrospect for each individual object. The ordering software is to be created according to the assortment for the city administration of Lahr. New creation of products are to be set only after order of the department head building service or his deputy of the city of Lahr.5. Predefined articles with manufacturer specificationIn the bill of quantities the manufacturers of the articles were partly named. These articles fit into an already existing system and must be continued for economic reasons.6.Delivery of cleaning and care products + cleaning accessoriesra) The individual collection points are distributed over the entire city area as well as the districts (a list of the objects to be supplied is attached).b) If necessary, individual containers are called off.c) The contractor is liable for the proper packaging and loading of the cleaning products, cleaning equipment, hygiene material and other cleaning supplies, for proper transport to the individual collection points as well as for damage and theft.d) The ordered goods shall be delivered within 4 working days after call-off.e) Since the janitors at the individual collection points are also charged with tasks within the scope of their official duties that require them to leave the official building temporarily, it is urgently required that the respective delivery date be agreed with the janitors at least one hour before delivery.f) The goods shall be deemed not to have been delivered unless the delivery bill is signed exclusively by the janitor or a representative of the building service.7 .WarehousingThe Customer does not operate a central warehousing system; warehousing at the individual collection points is kept to a minimum.8. Special noticeIn the course of delivery, break yards in schools, kindergartens, after-school care centers, etc. are also used. The risks of accidents associated with this must be taken into account by the bidder. Specified speed limits on the premises must be complied with.9. environmental compatibilityMinimum criteria:The cleaning agents to be used must meet the requirements listed in the specifications.10LabelingDeliveries of cleaning chemicals labeled in accordance with the Ordinance on Hazardous Substances must be provided with a safety data sheet and operating instructions in accordance with the EC Directive.The packaging/containers must be labeled in German with information on ingredients, safety precautions and a recommendation for use, including dosage.In addition, for each product that can be transferred into dosing bottles, labels for dosing bottles containing information on the possible application, dosing, etc. of the product shall be provided to the Customer free of charge during the entire term of the contract if required.11Empty containers The bidder is obliged to take back empty containers of his products free of charge. Workers who do not meet these requirements must be replaced at the request of the client.Only instructed personnel may be used as vacation and sickness replacements. The bidder shall ensure through organizational measures (appointment of substitutes) that the delivery of materials is not impaired by staff absences due to illness, vacation, etc. Foreign workers may only be employed if valid work and residence papers are available and sufficient German language communication is ensured.The bidder shall be liable to the contracting authority within the scope of the liability insurance for all damage caused by its agents or employees. The bidder assures that it is technically and economically capable of executing the order to the extent envisaged. In the event of failure to perform the agreed service and other contractual obligations, the Client shall terminate the contract in writing without notice if these have been unsuccessful.The Bidder undertakes to comply with all general and special accident prevention regulations and safety measures applicable to the object.10. Subcontractors:The transfer of services to subcontractors is permissible. The bidder must inform the client accordingly in writing when submitting the bid, together with all details of the subcontractor and its services.11. Notification of defects:Defects and damage to rooms and furnishings must be reported immediately to the building management office. Insofar as these defects and damages pose a risk to the personnel, the work may not be carried out before the identified complaints have been remedied. The liability of the client due to violation of the traffic safety obligation remains unaffected.12. Contract period, option and end-of-contract clauseThe offered rental prices must be binding for the first contract year. From the 2nd year of the contract, price adjustments may be asserted. These shall be admissible provided that the bidder can prove that it cannot maintain its bid prices, that its supplier(s) has/have previously effectively increased prices vis-à-vis it. The contracting authority reserves the right to examine the price adjustment and to submit the relevant evidence. The price adjustment requires the consent of the customer. The newly agreed price shall then be valid for at least another 12 months. If no agreement is reached on the new prices, the contract shall be deemed terminated with a notice period of 3 months.The contract prices shall also include, among other things, the financial effects arising from the application of the Gütergefahrenordnung Straße (Road Freight Danger Regulations), from other statutory or other regulations already in force or expected for the delivery period.The Customer shall have the option (option) to declare to the Bidder one month prior to the expiry of the contract term to waive the removal of all equipment and materials pursuant to item 4 and to take over the equipment and materials used into its ownership free of charge. The bidder shall not assert any claims against the City of Lahr that prevent the continued operation of the equipment by the City of Lahr or a third party commissioned by the City of Lahr. In the event that the takeover of the donors is waived, the contractor shall remove and dispose of all loaned items at his own expense.13. Liability:The bidder shall ensure that adequate safety precautions are taken. He shall be liable for personal injury, property damage and financial loss caused by him and his vicarious agents. 14 Termination:The donor loan agreement may be terminated by either contracting party at any time without giving reasons with a notice period of 6 months to the end of each month. However, termination is permitted at the earliest after the end of the first contract year. The client may terminate the contract at any time with a notice period of 14 calendar days if a municipal object is no longer used by him - either temporarily or permanently - and no more rental objects are required as a result. If only parts of the object are no longer used, the termination may - at the request of the bidder - be limited to these parts. The client is entitled to terminate the contract without notice for important reasons. In particular, the following shall be deemed to be good cause: - The bidder participates in agreements restricting competition (§ 1 of the Act against Restraint of Competition). - The bidder does not pay the employees of its company the benefits stipulated by collective bargaining or by law or does not pay them in full or violates the provisions of § 12 (prohibition of temporary employment relationships) or tolerates such violations by a subcontractor recognized in accordance with § 13. - The Bidder grants, promises or offers advantages to persons involved in the preparation, conclusion or execution of the Contract on the part of the Client, regardless of their affiliation with the Client. - The Bidder ceases to perform the services or composition proceedings are opened against it. - The bidder seriously violates the provisions of the contract, so that the contracting authority cannot be expected to continue the contractual relationship: such violations may include, for example: the assumed services are not performed at the time specified by the contracting authority or not performed in the time and manner specified in the contract, and despite a written reminder, no remedy is provided. Employees are found who do not have the required work permit. False declarations have been made in the offer. Notice of termination shall be given in writing.15. The term of the contract or rental property shall not be extended by the change, but shall be based on the term of the contract (12.). Changes and additions to the specifications and price agreements must be made in writing.The bidder declares to accept the above conditions in the event of awarding the contract and to prepare the offer in accordance with the required services (including attachments). For all employees of the bidder, the work guidelines as well as the house rules of the object apply.
