Poland - Construction work for buildings relating to railway transport

Description

The subject of the contract is the execution of works related to the reconstruction of Radymno railway station.2 The description of the subject of the contract (hereinafter referred to as "OPZ"), constitutes Annex 2 to the ToR and includes: construction design, detailed design, technical specifications of execution and acceptance of works and works' measures, construction permit. The Contracting Authority emphasises that all works covered by the scope of the contract should be performed in accordance with the design documentation, technical specification of execution and acceptance of works, the Contracting Authority's guidelines, recommendations and issued decisions, as well as legal regulations and standards. The Contractor is obliged to perform the contract on the terms and conditions specified in the model contract - Appendix No. 9 to the ToR and in the ToR and in the ToR. The Contractor or subcontractor is obliged to employ persons performing work on the basis of an employment contract, within the meaning of art. 22 § 1 of the Act of 26.6.1974. - Labour Code (Journal of Laws of 2018, item 917; as amended). The employment obligation applies to employees who, under the Agreement to be concluded as a result of the award of the contract in question, will perform the following activities: 1) bricklaying, roofing, activities performed as a bricklayer's assistant,2) settlement and maintenance of construction documentation4. The requirement of employment under the employment contract does not apply to persons performing other scopes of work, in particular: construction site managers, geodesic service providers, construction materials suppliers.5 During the performance of the Contract, the Contractor is obliged to submit, within 5 days from the date of requesting by the Contracting Authority, statements and documents, which the Contracting Authority is entitled to request in connection with the performance of control activities towards the Contractor with regard to the Contractor's or subcontractor's compliance with the requirement of employment under the employment contract of persons performing the tasks indicated in point A.2.1. In connection with the request of the Awarding Entity referred to in item 5, the Contractor shall be obliged to submit the following documents in particular: a declaration of the Contractor or a subcontractor on employment on the basis of a contract of employment of persons performing the activities covered by the Awarding Entity's request. This declaration should include, in particular: 1) precise definition of the entity making the declaration, 2) date of submission of the declaration, 3) indication that the activities covered by the call are performed by persons employed on the basis of an employment contract together with an indication of the number of such persons, 4) type of employment contract and full-time equivalent, 5) signature of the person entitled to submit the declaration on behalf of the contractor or subcontractor.7Detailed rules, conditions and sanctions concerning employment on the basis of an employment contract have been specified in Chapter III of the ToR.8. The Contracting Authority does not envisage organizing local inspections of construction works with its participation, however, it is recommended that the Economic Operator should check in detail in the field the conditions of performing the subject of the contract.9The Contracting Authority admits the possibility of subcontracting a part of the contract.10. The Contractor is obliged to indicate in the document ONE, constituting Appendix 3 to the ToR, the parts of the contract which the Contractor intends to subcontract and to provide the names of subcontractors (if known at this stage).11.
