THE CALL FOR TENDERS AND THE PRESENTATION OF BIDS
PRELIMINARY INFORMATION
PURPOSE OF THE CALL FOR TENDERS
The Commission scolaire des Chênes (hereinafter referred to as the CSDC), which has its head office in the city of Drummondville, wishes to obtain the services of engineering professionals (civil, structural, mechanical and electrical) for the construction of a new primary school D to be located in Drummondville in the Marconi sector.
DEADLINE FOR THE CALL FOR TENDERS AND PLACE OF RECEIPT OF TENDERS
Bids for this call for tenders must be submitted in four (4) copies, one (1) of which must be clearly identified, before 11:00 a.m., local time, October 28, 2019, to the attention of Material Resources, to be received at the following address:

The offices of the Commission scolaire des Chênes are open Monday to Friday from 8:30 am to 11:45 am and from 1 pm to 4 pm.
The bidder must complete its bid in accordance with the procedures set out in the article entitled "Preparation and presentation of the bid" of the instructions to service providers.
Any bid sent by fax, email or received later will be automatically rejected.
PROCEDURE FOR RECEIVING AND EXAMINING COMPLAINTS
The procedure for receiving and examining complaints is available on our website at the following address:

This procedure applies if the public contract to be awarded involves expenditure of public funds and expenditure equal to or greater than the applicable minimum public tender threshold.
For the purposes of this call for tenders, the public contracts that may be the subject of a complaint are service contracts, other than a contract for the integration of the arts into the architecture and environment of government buildings and sites, contracts treated as service contracts are charter contracts, transportation contracts other than those subject to the Education Act (RLRQ, Chapter I-13.3), damage insurance contracts and contracts of enterprise other than construction work contracts.

Any questions or requests relating to the tender documents must be submitted directly and only to the CSDC representative before the time and deadline for receipt of tenders.
PUBLIC OPENING OF BIDS
Upon expiry of the deadline for receipt of tenders, their public opening shall be held at the place indicated in the article entitled "Deadline for the call for tenders and place of receipt of tenders" above, immediately after the deadline for their receipt, at the same place and on the same day.
WARNING
The service provider must submit any questions or requests for amendments to the tender documents to the CSDC representative before the deadline for receipt of tenders.
Thus, by submitting its bid, the service provider accepts the terms, conditions and specifications of the tender documents.
Any resource that, during the two (2) years preceding the submission of the submission, was employed by the CSDC, and
Has held positions that may interact with this call for tenders or create a conflict of interest situation;
or
Participated directly or indirectly in the preparation of the estimate that is the subject of this call for tenders.
Any bid that does not meet any of the eligibility or compliance requirements described in the articles entitled "Eligibility Requirements for Service Providers" and "Submission Compliance Requirements" of the Instructions to Service Providers will be rejected.
Any service provider that is registered in the register of companies not eligible for public contracts (RENA) may not submit a tender for the conclusion of the contract covered by this call for tenders. This register can be consulted on the Treasury Board Secretariat's Internet site at the following address: http://www.rena.tresor.gouv.qc.ca.

It is strongly suggested that the service provider apply for a Revenu Québec certificate as soon as possible in order to resolve any potential problems related to obtaining it before the deadline set for the receipt of bids. Indeed, in accordance with the article entitled "Attestation de Revenu Québec" of the instructions to service providers, the service provider's certificate is valid until the end of the three (3) month period following the month in which it was issued.
In addition, the service provider's certificate must not have been issued after the deadline for receipt of tenders.
In the case of a consortium that is not legally organized, at the time of filing its bid, all companies making up the consortium must individually file a certificate from Revenu Québec.
In the case of a legally organized consortium, when filing its bid, as a general partnership, limited partnership or corporation, it must, as a service provider, file a single certificate from Revenu Québec.
A service provider may not transmit a Revenu Québec certificate that contains false or inaccurate information, produce for itself a third-party certificate or falsely declare that it does not hold the required certificate.
No person shall assist, by any act or omission, in contravening the provisions of the preceding paragraph or, by any encouragement, advice, consent, authorization or order, in causing a person to contravene them.
The violation of the provisions of the two preceding paragraphs constitutes an offence under the Regulation respecting service contracts for public bodies (RLRQ, chapter C-65.1, r. 4) and makes the perpetrator liable to a fine of $5,000 to $30,000 in the case of a natural person and $15,000 to $100,000 in other cases. In the event of a repeat offence within five (5) years, the amount of the minimum and maximum fines provided for shall be doubled.
Any offer, gift or payment, remuneration or benefit to be awarded this contract may result in the rejection of the bid or, if applicable, the termination of the contract.
The CSDC reserves the right not to consider any question or request made by a service provider if it is sent less than two (2) business days before the deadline for receipt of tenders.
INTERGOVERNMENTAL AGREEMENT
This in-service call for tenders is subject, depending on the value of the contract to be concluded, to the following intergovernmental agreements:
Agreement on the Liberalization of Public Procurement in Quebec and New Brunswick (AQNB);
Agreement on Trade and Cooperation between Quebec and Ontario (ACCQO);
Canadian Free Trade Agreement (CFFTA);
Comprehensive Economic and Trade Agreement (CETA).
A call for tenders valued at less than $365,700, but equal to or greater than $101,100, is subject to the NBQA, the ACCQO and the ALEC.
A call for tenders equal to or greater than $365,700 is subject to, NBQA, ACCQO, ALEC and CETA.

ATTESTATION RELATING TO THE INTEGRITY OF THE BIDDER
By filing the attached form entitled "Bidder's probity certificate", duly completed and signed by an authorized person, the bidder declares, in particular, that it has prepared this bid without collusion and without having established an agreement or arrangement with a competitor that is contrary to the Competition Act (L.R.C. 1985, c. C-34) enacted by the federal government, including the prices, methods, factors or formulas used to establish prices, the decision to submit, not submit or withdraw a bid, and the submission of a bid that voluntarily does not meet the specifications of the call for tenders. The Bidder also declares that neither it nor any person related to it has been found guilty within five (5) years of the date of submission of the Bid, of a criminal act or offence set out in point 9 of the Attestation.
In the case of a consortium that is not legally organized, at the time of submitting its bid, all companies making up the consortium must individually file a "Bidder's Integrity Statement".
In the case of a legally organized consortium, at the time of filing its bid, as a general partnership, limited partnership or joint stock company, it must, as a service provider, file only one "Certificate of the Bidder's Integrity".
COLLECTION AND USE OF PERSONAL AND CONFIDENTIAL INFORMATION
The collection and use of personal and confidential information will be carried out within the framework of the application of the Act respecting access to documents held by public bodies and the protection of personal information (RLRQ, chapter A-2.1), hereinafter referred to as the "Access Act", and subject to the exceptions provided for therein.
For the purpose of evaluating and validating bids submitted in this RFP, personal and confidential information may be collected and transmitted by the service provider, such as the curriculum vitae of its resources and certain business information. When such information is provided, it is accessible to persons sitting on the selection committee, to the relevant staff of the Financial and Material Resources Department and to representatives of the CSDC.
Once the contract is awarded, when personal and confidential information is collected, it is accessible to the person who must have access to it for the purposes related to the performance of the contract or to ensure compliance with the obligations of the parties, when the person is qualified to receive it, when the information is necessary for the performance of his duties and used for the purposes for which it was collected or when the law authorizes its use.
The person concerned by personal information held by the CSDC may have access to it and have it corrected, if necessary.
