Description

The subject of the contract is a service including cleaning in the facilities of the Customer consisting in daily, preventive and periodical thorough cleaning, auxiliary activities in patient service, internal transport and service of cloakrooms, reception rooms and telephone exchange in the L. Zamenhof University Children's Clinical Hospital in Białystok, ul. J. Waszyngtona 17.2. The detailed scope and required conditions for the performance of the service are specified in Attachment No. 5 to the ToS.3.The Contracting Authority shall enable the Contractors to make a site visit in order to familiarize themselves with the place of performance of the service in question and to assess the conditions related to the performance of works being the subject of the contract. Pursuant to art. 29 sec. 3a of the Public Procurement Law, the Contracting Authority requires the employment by the Contractor or Subcontractor on the basis of an employment contract of persons performing the activities specified by the Contracting Authority within the scope of contract performance, if the performance of these activities involves the performance of work in the manner specified in art. 22 § 1 of the Act of 26.6.1974 Labour Code. This obligation applies in particular to the following activities covered by the order in question: cleaning (daily, preventive), patient service support activities, internal transport, cloakroom, porter's lodge and telephone exchange service.5 The Contractor is obliged to submit to the Principal, within 7 days of signing the contract, a personal list of the above mentioned persons together with a specification of the activities performed by them and a statement confirming their employment under the contract of employment. An analogous list of persons together with the declaration concerning the employment of the above persons under the employment contract and not being in arrears with the payment of remuneration as at the date of submission of the declaration, the Contractor is obliged to submit at each request of the Purchaser. The above obligation also applies to all subcontractors participating in the implementation of the service.6. The Contracting Authority at each stage of the contract has the right to demand that the Contractor / Subcontractor document the fact of employing people on the basis of a contract of employment.7In the event of irregularities in the employment of workers by the Contractor or Subcontractor, the Purchaser reserves the right to inform the National Labour Inspectorate about this fact, in addition to being authorised to calculate a contractual penalty.8 The Purchaser allows for the execution of part of the contract, i.e. window cleaning, cleaning of carpets and blinds/verticali and mop washing and other work at heights by subcontractors. In other respects, the Contracting Authority requires the Contractor to perform the service on his own.
