The AOK - The Health Insurance Company of Lower Saxony intends to conclude non-exclusive drug discount contracts for the active ingredient Ambrisentan (ATC code: C02KX02) with as many market participants as possible (pharmaceutical entrepreneurs or communities of pharmaceutical entrepreneurs) in the so-called "open-house model" until exclusive contracts come into effect after a public invitation to tender in accordance with the regulations of Part 4 of the GWB.The AOK Lower Saxony will not make a selection decision and will submit an identical contract offer to every interested pharmaceutical company. In the open-house-model uniform conditions apply to all participants. Contract contents, conditions and access procedures are uniform - individual negotiations are generally not conducted. The contract periods are a maximum of twenty-four months, the earliest contract start date is 1.6.2020. All contracts end at the latest on 31.5.2022, regardless of the date of the respective contract conclusion. An accession or conclusion of a contract can be made within the twenty-four-month period on the first of each month. There is a right of termination 6 weeks to the end of each month. The AOK Niedersachsen reserves the right to replace the non-exclusive open-house discount contracts with exclusive discount contracts already during the contract period. With the coming into effect of advertised, exclusive discount contracts, the open-house contracts are terminated according to the contractual regulation, i.e. the open-house contracts end automatically. According to the experience of the AOK Niedersachsen, exclusive discount contracts generally come into force 6 to 8 months after publication of the corresponding tender notice in the Supplement to the Official Journal of the European Union. The future contract partners in the open-house model are requested to inform themselves regularly about these tender notices in the Supplement to the Official Journal of the European Union Interested pharmaceutical companies can request the contract documents and the contract conditions at the contact address mentioned under I.1) Contracts for the active substance Ambrisentan (ATC code: C02KX02) will be concluded for the first time with effect from 1.6.2020. Interested parties wishing to become contractual partners on this date must submit the contract documents to be submitted to the address stated in the contract documents by 27.4.2020. The date of receipt by the AOK Niedersachsen is decisive. Later contracts can be concluded on the first of each month during the twenty-four-month maximum term. In organisational terms, the AOK generally requires a lead time of 35 calendar days in order to be able to guarantee the necessary work, e.g. registration of the contract in the Lauer-Taxe®. The exact deadlines for receipt are announced with the contract documents. This publication does not constitute the award of a public contract within the meaning of Directive (2014/24/EU) or the ARC. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, publication is made in the Supplement to the Official Journal of the European Union. In the absence of an appropriate publication form, the contract notice is used. The resulting conceptual specifications, such as the procedure designation "open procedure", are solely due to the use of this contract notice form and the publication platform. This does not imply any further significance, in particular a subjection to regulations under public procurement law, unless they are mandatory for legal reasons.
