A framework agreement for the shareholders of PD - Berater der öffentlichen Hand GmbH (hereinafter "PD") is being put out to tender. In this award procedure, PD acts as the central awarding authority for the shareholder federal states and will initially award the framework agreement in its own name, but the shareholder federal states shall then also be entitled to make the individual calls from the framework agreement of PD in their own name and for their own account. The contract will be awarded by PD in accordance with the same rules that would also apply to the shareholder federal states for the corresponding contract award, so that the subsequent change of client does not constitute a circumvention of obligations under public procurement law or a shift in the economic balance.

The contract will be divided into two lots and awarded to one contractor each, one for the shareholder federal states from eastern Germany and one for those from western Germany.

The contract comprises a basic development with licensing for each calling federal state as well as programming of the state-specific adaptations for each calling federal state and the subsequent operation and support of the solution for each calling federal state for all hospitals and ministries connected there for a basic term of two years from commissioning (productive operation) of the first project phase of the corresponding state solution, which is extended by a further year in each case, unless the contract is terminated by one of the parties with a notice period of at least nine months before the end of the corresponding contract period.
The Contractor shall be entitled to adjust the agreed prices for operation and support annually after the end of the second contract year in accordance with the price development pursuant to Section 71 (3) SGB V for the following years. A corresponding price increase shall come into effect 2 months after receipt of the Contractor's justified request for an increase by the Client concerned.
The maximum value of the framework agreement is stated as ? 4 million net.
